<br />CITY OF ROSEVILLE <br />PLANNED UNIT DEVELOPMENT PHASE I AGREEMENT # <br />(DRAFT) <br /> <br />AGREEMENT, dated , 1998, between the City of Roseville, a Minnesota <br />municipal corporation (herein referred to as "CITY"), and Lexington Plaza, LLC, a <br />Minnesota limited liability corporation (herein referred to as "DEVELOPER"). <br /> <br />1.0 Effective Date of Agreement <br /> <br />This agreement shall be effective upon completion of the following: 1) passage and <br />publication of Ordinance # (Rezoning of Property to PUD) and 2) execution of this <br />agreement by the CITY and the DEVELOPER. <br /> <br />2.0 Request for Planned Unit Development Phase I <br /> <br />The DEVELOPER has asked the CITY to approve Phase I of Planned Unit Development <br />(PUD) (PF#2990), which will allow the operation of dry cleaning service facilities within the <br />existing two-building 96,000 square foot (approximate) multi-tenant center, in addition to <br />the uses customarily allowed in the underlying B-2 zoning district, for the property legally <br />described as follows: <br /> <br />Part of the West Half of the Southwest Quarter of the Southwest Quarter of Section <br />14, Township 29 - Range 23 (PIN 142923330065), and as more specifically <br />described in the attached Exhibit A. <br /> <br />3.0 Planned Unit Development Phase I Approval <br /> <br />The CITY hereby grants approval of the final development plan for Phase I of the <br />Lexington Plaza Planned Unit Development, subject to the DEVELOPER's compliance with <br />the terms and conditions of this agreement. <br /> <br />4.0 Rezoning <br /> <br />The CITY conducted a hearing and meetings on March 11, 1998 (Planning Commission - <br />hearing on concept and final development plan for Phase I) and March 23, 1998 (City <br />Council - action on concept and final development plan for Phase I) to consider the <br />Planned Unit Development, including the rezoning of the subject property from B-2 Retail <br />Business to PUD Planned Unit Development. The CITY agrees to rezone the subject <br />property to PUD, subject to the DEVELOPER's strict compliance with the approved terms <br />and conditions of this agreement. Where not superseded by more restrictive requirements <br />of this PUD, the standards of the underlying B-2 zoning district shall apply, as stated in <br />Chapter 1005 of the Roseville City Code. <br /> <br />PUD Phase I Agreement #_ (Lexington Plaza) - Page 1 of 4 <br />
