2.3 It is the policy of the City of Roseville to issue minor variances when there is a
hardship or practical difficulty, provided the property is located in an R-1, Single
Family Residential District, and used for residential purposes.

I",.

2.4 Section 1004.02(0)(5), City Code, requires a minimum side yard setback of 10 feet.

Ul MINOR VARIANCE COMMITTEE

3.1 The request for the variance included the required application form, sketch of the
property and proposed driveway, written statement from the applicant, and written
approval from the adjacent property owner affected by the variance (Donald Weber
at 2442 Western Avenue).

3.2 The Minor Variance Committee reviewed this request on Tuesday, March 10,1998,
and unanimously recommended approval of a minor variance to reduce the side
yard setback to six feet for the purpose of constructing a one-car addition to an
existing two-car attached garage at 2450 Western Avenue, based on the following
findings:

1. The location of the existing garage, the topography of the parcel, and the
location of a swimming pool in the rear yard creates a practical difficulty for
the applicant.

2. The proposed garage addition will be on the south side of the house. The
garage for the house to the south is located on the north side of their house;
therefore, the setback variance will reduce the garage to garage setback and
will not adversely impact the property to the south.

3. The proposed variance is in harmony with the general purpose and intent of
the City's Comprehensive Plan and Title 10 of the City Code (Zoning).

4. The variance, if granted, will not adversely affect the public health, safety, or
general welfare.

4.0 SUGGESTED ACTION

4.1 By motion, approve Raymond Jack's request for a minor variance to reduce the side
yard setback to six feet for the purpose of constructing a one-car addition to an
existing two-car attached garage at 2450 Western Avenue, based on the findings
of the Minor Variance Committee outlined in section 3.2 of this report and with the
following provision:

1. A detached garage cannot be constructed on this property.

Attachments: Property location map; minor variance application; written statement from applicant; written
consent from adjacent property owners; sketch of property.
60-day Time Limit Application accepted on March 4,1998; Decision deadline is May 2, 1998,
Prepared by: Kim L.
