<br />2.3 It is the policy of the City of Roseville to issue minor variances when there is a <br />hardship or practical difficulty, provided the property is located in an R-1, Single <br />Family Residential District, and used for residential purposes. <br /> <br />I",. <br /> <br />2.4 Section 1004.02(0)(5), City Code, requires a minimum side yard setback of 10 feet. <br /> <br />Ul MINOR VARIANCE COMMITTEE <br /> <br />3.1 The request for the variance included the required application form, sketch of the <br />property and proposed driveway, written statement from the applicant, and written <br />approval from the adjacent property owner affected by the variance (Donald Weber <br />at 2442 Western Avenue). <br /> <br />3.2 The Minor Variance Committee reviewed this request on Tuesday, March 10,1998, <br />and unanimously recommended approval of a minor variance to reduce the side <br />yard setback to six feet for the purpose of constructing a one-car addition to an <br />existing two-car attached garage at 2450 Western Avenue, based on the following <br />findings: <br /> <br />1. The location of the existing garage, the topography of the parcel, and the <br />location of a swimming pool in the rear yard creates a practical difficulty for <br />the applicant. <br /> <br />2. The proposed garage addition will be on the south side of the house. The <br />garage for the house to the south is located on the north side of their house; <br />therefore, the setback variance will reduce the garage to garage setback and <br />will not adversely impact the property to the south. <br /> <br />3. The proposed variance is in harmony with the general purpose and intent of <br />the City's Comprehensive Plan and Title 10 of the City Code (Zoning). <br /> <br />4. The variance, if granted, will not adversely affect the public health, safety, or <br />general welfare. <br /> <br />4.0 SUGGESTED ACTION <br /> <br />4.1 By motion, approve Raymond Jack's request for a minor variance to reduce the side <br />yard setback to six feet for the purpose of constructing a one-car addition to an <br />existing two-car attached garage at 2450 Western Avenue, based on the findings <br />of the Minor Variance Committee outlined in section 3.2 of this report and with the <br />following provision: <br /> <br />1.
