The site must be developed in accordance with the plans submitted and
approved in conjunction with the request for an amendment to the approved
planned unit development (site plan dated 3/9/98; grading, drainage, erosion
control, & utilities plan dated 3/9/98; landscape plan dated 3/9/98; building
floor plan dated 3/9/98; and exterior building elevations dated 3/9/98). Minor
variations from the approved site plan may be approved by the City's
Development Review Committee, under the direction of the Community
Development Director; however, any substantial departures from the
approved site plan will require another amendment to the PUD.

2. Final grading and utility plans must be reviewed and approved by the Public
Works Director. Since the impervious surface on the site will increase, the
applicant will need to contact the Rice Creek Watershed District for permit
requirements.

3. The erosion problem along the western edge of the property must be
corrected in conjunction with site and landscape development and the
erosion control along the western edge of the property must be corrected in
conjunction with site development; and further, that the staff investigate the
size of trees on the west side (as per staff recommendations on landscape
plan of 3/5/98) and review the retaining wall requirements for safety fencing.

Note: Finance and Community Development staff point out that this property is
subject to a previous TIF Development Agreement with College Properties. In
addition to the land use decisions, the Council should direct the staff to review the
impacts of this land use change on the T/F Development Agreement, and potentially
a Payment In Lieu of Taxes (PILOT) agreement. Briggs and Morgan has completed
a draft of this agreement and it is attached.

PF#2995 - RCA (04/27/98) - Page 4 of 5
