<br />3.0 STAFF COMMENT <br /> <br />3.1 In reviewing this request, staff has made the following findings: <br /> <br />1. The sanitary sewer within this easement provides service to the existing building on the <br />property and to the building to the east (MILSOLV Minnesota). The proposed sanitary sewer <br />realignment will not affect sanitary sewer service to this property, <br /> <br />2. The vacation of the existing sanitary sewer easement will facilitate the expansion of the <br />existing Old Dutch facility. The removal ofthe northern portion ofthe former Viking Sprinkler <br />building will also create separation between the Old Dutch building and the API building to <br />the north, <br /> <br />3. The proposed vacation of this sanitary sewer easement will not have an adverse impact on <br />the general public health, safety and welfare, provided a replacement sanitary sewer line and <br />easement are provided. <br /> <br />4.0 STAFF RECOMMENDA TION <br /> <br />4.1 Based on the findings outlined in Section 3.1 of this report, staff recommends <br />approval of the request for vacation of a 20' sanitary sewer easement and the <br />acceptance of a new 18' sanitary sewer easement by the City, with the following <br />provision: <br /> <br />1. The sanitary sewer line must be relocated, the new sanitary sewer line must <br />be accepted by the City, and the new sanitary sewer easement must be <br />accepted by the City prior to the existing easement being vacated. <br /> <br />5.0 PLANNING COMMISSION RECOMMENDA TION <br /> <br />5.1 On April 8, 1998, the Planning Commission recommended approval (7-0) of the <br />request for vacation of a 20' sanitary sewer easement and the acceptance of a new <br />18' sanitary sewer easement by the City, based on the findings outlined in Section <br />3.1 and with the provision included in Section 4.1 of this report. <br /> <br />6.0 SUGGESTED COUNCIL ACTION <br /> <br />6.1 By resolution, approve of the request for vacation of a 20' sanitary sewer <br />easement and the acceptance of a new 18' sanitary sewer easement by the City, <br />based on the findings outlined in Section 3.1 and with the provision included in <br />Section 4.1 of this report. <br /> <br />Attachments: location map; notification map; notice of public hearing; sketch of existing and proposed <br />easements; legal description of proposed easement; sketch of proposed relocated sanitary sewer line; and <br />letter from Ulteig Engineers. <br /> <br />60-day Time Limit application submitted on March 9, 1998; application accepted as complete on March 18, <br />1998; decision deadline is May 8,1998, <br />Prepared by: Dennis Welschl Kim L.
