<br />~ <br /> <br />REQUEST FOR CITY COUNCIL ACTION <br />DATE: 04/27/98 <br />ITEM NO: 1-6 <br />M~gel~pproved: Agenda Section: <br />~& LAND USE <br />Old Dutch Foods, Inc. request to vacate a sanitary sewer easement <br />and accept a replacement easement on property north of 2375 <br />Terminal Road (PF2996). <br /> <br /> <br />1.0 REQUESTEDACnON <br /> <br />1.1 Old Dutch Foods, Inc. is requesting the vacation of an existing sanitary sewer <br />easement and the acceptance of a replacement easement on property north of <br />2375 Terminal Road (former Viking Sprinkler property). The sanitary sewer would <br />be re-routed and the new easement accepted prior to vacation of the existing <br />easement by the City. <br /> <br />2.0 BACKGROUND <br /> <br />2.1 Old Dutch Foods, Inc. is requesting the vacation of a 20' sanitary sewer easement <br />across the southern edge of the property directly north of 2375 Terminal Road. Old <br />Dutch has recently acquired this parcel, which was previously occupied by Viking <br />Sprinkler, and intends to combine the parcel with its parcel to the south. Old Dutch <br />also proposes to expand its existing building at 2375 Terminal Road to the north <br />and connect it to the southern portion of the old Viking Sprinkler building. Since a <br />building cannot be constructed over a sanitary sewer line or easement, Old Dutch <br />is proposing to relocate the sanitary sewer and provide the City with a replacement <br />easement. This would allow the existing easement to be vacated and remove an <br />obstacle to the expansion plans. The northern portion of the Viking Sprinkler <br />building will be removed in order to accommodate the proposed sanitary sewer <br />realignment. <br /> <br />2.2 The sanitary sewer within this easement provides service to the existing building on <br />the property as. well as to the property to the east (MILSOLV Minnesota <br />Corporation). The property to the east will continue to be served with the realigned <br />sanitary sewer line, which will reconnect with the existing line on the Old Dutch <br />property west side of the railroad tracks. <br /> <br />2.3 The applicant is also working with the City's building codes staff regarding the <br />overall size of the proposed addition (allowable area), and with the City's <br />engineering staff regarding storm water drainage (realignment). <br /> <br />2.4 Section 1013.04 outlines the procedure for vacating streets, alleys, and easements. <br /> <br />PF#2996 - RPCA (04/08/98) - Page 1 of 2 <br />
