REQUEST FOR COUNCIL ACTION DATE: 11/23/98 ITEM NO.: Depa~APproval: Manager Reviewed: Agenda Section: Item Description: City of Roseville Request to Vacate a Portion of Dell~ood Street (PF-2997) Background: The City of Roseville is requesting the vacation of a portion DelJwood Street from County Road B-2 south to Highway 36 (between the Roseville Area High School property and the Grace Church property). This segment of Oellwood Street is in very poor condition and in need of repair. As was discussed during public hearings for the 1998 Pavement Management Program, Oellwood Street acts primarily as a driveway to the high school. Because Dellwood Street no longer functions as a pubHc roadway, staff has recommended that the right-of-way be vacated and that on -going maintenance responsibilities for the existing pavement be shared by the School District and Grace Church. This request was reviewed by the Planning Commission on April 8, 1998. Following concern raised by the School District about the loss of the use of this roadway by the School District, the Planning Commission recommended denial of the request to vacate the roadway. Since the Planning Commission meeting, staff has met with representatives of both the School District and the Grace Church to discuss options that would preserve the use of the roadway but transfer its ownership from the City to adjoining properties. City staff has been working with Grace Church and the School District to develop an agreement that outlines future maintenance responsibilities for the vacated right-of-way. The following solution is proposed: 1) Both the Grace Church and the School District will grant each other an access easement over their portion of the vacated right-of-way. The easements will include the following provisions: a) Until such time as Grace Church actively uses the vacated Oellwood Street, the School District will be responsible for all ongoing operation and maintenance costs. In addition, the cost to reconstruct the access on the vacated Dellwood Street will be paid 75% by the School District and 25% by Grace Church. b) At such time as Grace Church utilizes the vacated Oellwood Street, the cost of future reconstruction and operations and maintenance will be split evenly between the School District and Grace Church.
