<br />'} _..."1" <br /> <br />:..."': <br /> <br />............" <br /> <br />'---" <br /> <br />\....../ <br /> <br />e A F/t <. <br /> <br />REQUEST FOR COUNCIL ACTION <br /> <br />DATE: 11/23/98 <br /> <br />ITEM NO.: <br /> <br />Depa~APproval: <br /> <br />Manager Reviewed: <br /> <br />Agenda Section: <br /> <br />Item Description: City of Roseville Request to Vacate a Portion of Dell~ood Street (PF-2997) <br /> <br />Background: The City of Roseville is requesting the vacation of a portion DelJwood Street <br />from County Road B-2 south to Highway 36 (between the Roseville Area High School property <br />and the Grace Church property). <br /> <br />This segment of Oellwood Street is in very poor condition and in need of repair. As was <br />discussed during public hearings for the 1998 Pavement Management Program, Oellwood <br />Street acts primarily as a driveway to the high school. Because Dellwood Street no longer <br />functions as a pubHc roadway, staff has recommended that the right-of-way be vacated and <br />that on -going maintenance responsibilities for the existing pavement be shared by the School <br />District and Grace Church. <br /> <br />This request was reviewed by the Planning Commission on April 8, 1998. Following concern <br />raised by the School District about the loss of the use of this roadway by the School District, <br />the Planning Commission recommended denial of the request to vacate the roadway. <br /> <br />Since the Planning Commission meeting, staff has met with representatives of both the School <br />District and the Grace Church to discuss options that would preserve the use of the roadway <br />but transfer its ownership from the City to adjoining properties. City staff has been working <br />with Grace Church and the School District to develop an agreement that outlines future <br />maintenance responsibilities for the vacated right-of-way. The following solution is proposed: <br /> <br />1) Both the Grace Church and the School District will grant each other an access easement <br />over their portion of the vacated right-of-way. The easements will include the following <br />provisions: <br /> <br />a) Until such time as Grace Church actively uses the vacated Oellwood Street, the School <br />District will be responsible for all ongoing operation and maintenance costs. In <br />addition, the cost to reconstruct the access on the vacated Dellwood Street will be paid <br />75% by the School District and 25% by Grace Church. <br /> <br />b) At such time as Grace Church utilizes the vacated Oellwood Street, the cost of future <br />reconstruction and operations and maintenance will be split evenly between the School <br />District and Grace Church. <br />
