<br />5.0 PLANNING COMMISSION RECOMMENDA TIONS <br /> <br />5.1 At the hearing held on April 8, 1998, the Commission heard from John Thein <br />representing the School District. He urged the Commission to rebuild the street, not <br />vacate it. See below: <br />(Excerpt from draft minutes of Planning Commission meeting) <br />Chair Harms opened the hearing and request Jay Kennedy summarize the Dellwood vacation <br />report dated April 4. 1998. <br /> <br />Jay Kennedy described the Dellwood Street vacation and the purposes for the street (access. <br />connection), and recommended approval of vacation while retaining drainage and utility <br />easements within the right-of-way. <br /> <br />Member Olson asked for details regarding ownership of church parcels. Member Mulder <br />commented that the church could sell the adjoining houses - would there be frontage. <br /> <br />Chair Harms asked for clarification of why the vacation was supported by the owners. Jay <br />Kennedy state the cost ($85,000) was the major impediment. <br /> <br />John Thein, Deputy School Superintendent, Roseville Area School District 622, asked what <br />rights to challenge the vacation. Is there a required number of meetings that the City must <br />hold with the property owners. Jay Kennedy noted that school and church representatives <br />were invited to respond in November, 1997. The street is also used by the community - has <br />the fire and police departments been asked to comment on the vacation. Is there City cost if <br />the road is improved and assessed? <br /> <br />Chair Harms asked if the school district would accept an assessment? (Yes). <br /> <br />Chair Harms asked what will happen if the street is not there. John Thein suggested adding <br />new curb cuts and new roadways. The school district wo~ld like to keep the street and exit. <br /> <br />Member Olson asked if Grace sold the lots, would the City take back the right-of-way (no). <br />However the lots would have 33 feet of right-of-way to be used as a driveway. <br /> <br />Member Mulder asked for clarification regarding staff procedure to vacate a street. Jay <br />Kennedy stated no direction or interest was received from either party. <br /> <br />Member Rhody noted that there are hesitant agencies and city departments. <br /> <br />John Thein noted vacation would have a health, safety and welfare impact. Dellwood is a <br />public street for many events beside school and church. The school district wishes to have <br />the street rebuilt, not vacated. The district asks that the Planning Commission table this <br />issue. <br /> <br />Motion: Member Harms moved, Member Wilke seconded, to recommend denial of the request <br />to vacate a portion of Dellwood Street (PF2997). Roll call: Ayes: Harms, Wilke, Cunningham, <br />Klausing, Olson, Mulder, Rhody. Nays: None. Motion carried: 7-0 <br /> <br />5.2 The Commission recommended denial of the request for vacation of a portion of the <br />right-of-way known as Dellwood Street from the southerly edge of the County Road <br />B-2 right-of-way approximately 600 feet south to the northerly edge of the Highway <br />36 right-of-way (between the Roseville Area High School property and the Grace <br /> <br />PF#2997 - RPCA (04/27/98) - Page 4 of 4 <br />
