2.3 It is the policy of the City of Roseville to issue minor variances when there is a
hardship or practical difficulty, provided the property is located in an R-1, Single
Family Residential District, and used for residential purposes.

2.4 Section 1012.01(B), City Code, requires a minimum side yard setback of five feet
for parcels platted before May 21, 1959.

Section 703.04(B)(9), City Code, requires a minimum side yard setback of five feet
for a residential driveway.

3.0 MINOR VARIANCE COMMITTEE

3.1 The request for the variance included the required application form, sketch of the
property and proposed driveway, written statement from the applicant, and written
approval from the adjacent property owner affected by the variance (Leon Perszyk
at 2085 Hamline Avenue).

3.2 The Minor Variance Committee reviewed this request on Tuesday, March 31, 1998,
and unanimously recommended approval of a minor variance to reduce the side
yard setback to three feet for the purpose of constructing a one-car addition and
expanding a driveway at 2095 Hamline Avenue, based on the following findings:

1. The presence of numerous mature trees on the parcel, the topography of the
parcel, and the location of the existing attached garage creates a practical
difficulty for the applicants.

2. The width of the driveway will not exceed 26 feet at the property line;
however, the driveway will also be located less than the required five feet
from the south property line.

3. The proposed variance is in harmony with the general purpose and intent of
the City's Comprehensive Plan and Title 10 of the City Code (Zoning).

4. The variance, if granted, will not adversely affect the public health, safety, or
general welfare.

4.0 SUGGESTED ACTION

4.1 By motion, approve Stephen and Lori Gfrerer's request for a minor variance to
reduce the side yard setback of a garage addition and a driveway to three feet for
the purpose of constructing a one-car addition to an existing one-car attached
garage at 2095 Hamline Avenue, based on the findings of the Minor Variance
Committee outlined in section 3.2 of this report.

Attachments: Property location map; minor variance application; written statement from applicant; written
consent from adjacent property owners; sketch of property; photograph of property.
60-day Time Limit: Application accepted on March 25, 1998; Decision deadline is May 22, 1998.
Prepared by: Kim L.
