<br />2.3 It is the policy of the City of Roseville to issue minor variances when there is a <br />hardship or practical difficulty, provided the property is located in an R-1, Single <br />Family Residential District, and used for residential purposes. <br /> <br />2.4 Section 1012.01(B), City Code, requires a minimum side yard setback of five feet <br />for parcels platted before May 21, 1959. <br /> <br />Section 703.04(8)(9), City Code, requires a minimum side yard setback of five feet <br />for a residential driveway. <br /> <br />3.0 MINOR VARIANCE COMMITTEE <br /> <br />3.1 The request for the variance included the required application form, sketch of the <br />property and proposed driveway, written statement from the applicant, and written <br />approval from the adjacent property owner affected by the variance (Jack Hastings <br />at 1741 Chatsworth Street North). <br /> <br />3.2 The Minor Variance Committee reviewed this request on Tuesday, April 14, 1998, <br />and unanimously recommended approval of a minor variance to reduce the side <br />yard setback to three feet for the purpose of constructing a two-car attached garage <br />and a variance to reduce the driveway setback for the purpose of bringing an <br />existing driveway into compliance at 1747 Chatsworth Street North, based on the <br />following findings: <br /> <br />1. The substandard size of the parcel and the location of the house on the <br />property creates a practical difficulty for the applicant. <br /> <br />2. The width of the driveway will not exceed 26 feet at the property line. <br /> <br />3. The proposed variance is in harmony with the general purpose and intent of <br />the City's Comprehensive Plan and Title 10 of the City Code (Zoning). <br /> <br />4. The variance, if granted, will not adversely affect the public health, safety, or <br />general welfare. <br /> <br />4.0 SUGGESTEDACnON <br /> <br />4.1 By motion, approve David Jenkins' request for a minor variance to reduce the side <br />yard setback to three feet for the purpose of constructing a two-car attached garage <br />and a variance to reduce the driveway setback for the purpose of bringing an <br />existing driveway into compliance at 1747 Chatsworth Street North, based on the <br />findings of the Minor Variance Committee outlined in section 3.2 of this report. <br /> <br />Attachments: Property location map; minor variance application; written statement from applicant; written <br />consent from adjacent property owners; sketch of property; photograph of property. <br /> <br />60-day Time Limit: Application accepted on April 2, 1998; Decision deadline is June 1, 1998. <br />Prepared by: Kim L.
