<br />Good Evening Mayor & Council Members: <br /> <br />CD <br /> <br />"' <br /> <br />My nalne is Robert Kemnitz. I live at 1730 N. <br />Chatsworth Street, next door to Lois Nyman's property. <br />I am opposed to this variance of the standard 5 foot set <br />back. <br /> <br />The City code establishes a 5 foot set back from the <br />property line. What are the set back codes for, if not to <br />protect the interest of the neighbors? We are the <br />neighbors and our interest is in our trees. The City is <br />supposed to protect this interest by enforcing its codes} <br />instead of being unduly influenced by the prospect of an <br />increased tax base. <br /> <br />The two mature maple trees in question have been <br />established for 10 & 30 years -long before any <br />discussion of a garage addition. Since the May 27th <br />Planning COlnmission meeting, I have consulted with <br />Kunde Tree and the University of Minnesota Extension <br />Services. <br /> <br />I would like to quote from a statement provided by <br />Kunde Tree explaining how this set back could adversely <br />affect the health of these trees. <br />
