REQUEST FOR COUNCIL ACTION

DATE: 04/27/98
ITEM NO:
Manager Approved: Agenda Section:
CONSENT
Marian & Roy Geschwind request for a minor variance to increase the
height of a fence at 1404 Talisman Curve (PF#3009).

1.0 REQUESTED ACTION

1.1 Marian & Roy Geschwind are requesting a minor variance to increase the height of
a fence within the front yard setback area of County Road C to 6 feet at 1404
Talisman Curve. Mr. and Mrs. Geschwind would also like to place the board side
of the fence facing the house as opposed to facing the street.

Requirement

Proposal

Variance

Fence Height - 4'

6' fence

2' variance

2.0 BACKGROUND

2.1 Marian & Roy Geschwind own a home at 1404 Talisman Curve. The property is
zoned R-1 Single Family Residential and adjacent land uses are single family
residential to the north, east, and west. Industrial uses are located to the south
across County Road C.

2.2 Mr. and Mrs. Geschwind are requesting a variance from Section 1 012.02(B)(2), City
Code, to increase the height of a fence in a front yard to 6 feet. The Geschwind's
lot is a through lot, with frontage on both Talisman Curve and County Road C.
Because of the high traffic levels on County Road C the applicant's have little
privacy in their rear yard; therefore, they would like a higher fence in order to
provide a usable private space in the rear yard. Most of the other properties in this
block, including the homes on either side of the applicants, were granted similar
variances in the 1980s. The neighbor to the east has the board side of the fence
facing the house, while the neighbor to the west has the board side of the fence
facing the street. The boulevard width along the north side of County Road C is
approximately 30 feet; therefore, the proposed fence will not adversely impact sight
lines at the intersection of County Road C and Sheldon Street. The location of the
lot adjacent to County Road C and across County Road C from an industrial
area, as well as the character of the parcel (through lot), creates a practical
difficulty for the applicants.

2.3 It is the policy of the City of Roseville to issue minor variances when there is a
hardship or practical difficulty, provided the property is located in an R-1, Single
Family Residential District, and used for residential purposes.

PF#3009.
