<br />2.4 Section 1 012.02(B)(2), City Code, allows a maximum fence height of four feet within <br />the front yard setback area. This section also requires the board portion of a fence <br />to face the street or adjacent property. <br /> <br />3...Q MINOR VARIANCE COMMITTEE <br /> <br />3.1 The request for the variance included the required application form, a sketch of the <br />property and proposed fence, a written statement from the applicant, and written <br />approval from the adjacent property owners affected by the variance (Wayne & <br />Marjorie Heiman at 1412 Talisman Curve and Ralph Weber at 1398 Talisman <br />Curve). <br /> <br />3.2 The Minor Variance Committee reviewed this request on Friday, April 17, 1998, and <br />unanimously recommended approval of a minor variance to increase the height of <br />a fence within the front yard setback area of County Road C to 6 feet at 1404 <br />Talisman Curve, based on the following findings: <br /> <br />1. The location of the property adjacent to County Road C and across County <br />Road C from an industrial area adversely impacts the privacy of the <br />applicants. <br /> <br />2. The character of the parcel (through lot) creates a practical difficulty for the <br />applicants. <br /> <br />3. The proposed six foot fence will not impact site lines at the intersection of <br />Sheldon Street and County Road C. <br /> <br />4. None of the adjacent residences face toward County Road C; therefore, the <br />fence will not impact front yard views. <br /> <br />5. The proposed variance is in harmony with the general purpose and intent of <br />the City's Comprehensive Plan and Title 10 of the City Code (Zoning). <br /> <br />6. The variance, if granted, will not adversely affect the public health, safety, or <br />general welfare. <br /> <br />4.0 SUGGESTED ACTION <br /> <br />4.1 By motion, approve Marian & Roy Geschwind's request for a minor variance to <br />increase the height of a fence within the front yard setback area of County Road C <br />to 6 feet and place the board side of the fence facing the house at 1404 Talisman <br />Curve, based on the findings of the Minor Variance Committee outlined in section <br />3.2 of this report. <br /> <br />Attachments: Property location map; minor variance application; written statement from applicant; written <br />consent from adjacent property owners; sketch of property; photograph of property. <br />60-day Time Limit: Application accepted on April 16, 1998; Decision deadline is June 15, 1998. <br />Prepared by: Kim L.
