<br />3.0 MINOR VARIANCE COMMITTEE <br /> <br />3.1 The request for the variance included the required application form, a sketch of the <br />property and driveway, a written statement from the applicant, and written approval <br />from the adjacent property owners affected by the variance (Nick & Diana Jensen <br />at 1964 Fairview Avenue North). <br /> <br />3.2 The Minor Variance Committee reviewed this request on Tuesday, May 19, 1998, <br />and unanimously recommended approval of a minor variance to.jnif8888 reduce <br />the side yard setback of a driveway to less than one foot to allow the continuance <br />of a driveway and parking space at 1972 Fairview Avenue North, based on the <br />following findings: <br /> <br />1. Section 703.04(8)(9) of the City Code requires a residential driveway to be <br />set back a minimum of five feet from the side property line. The driveway <br />meets the setback requirement; however, an existing parking space on the <br />south side of the garage is located less than one foot from the property line. <br /> <br />2. The replacement driveway and parking space were installed in the same <br />location as the existing driveway and parking space. Mr. O'Connor recalls <br />getting permission from the adjacent property owner to install the parking <br />space next the garage many years ago; however, there is no variance on <br />record for this property. <br /> <br />3. The proposed variance is in harmony with the general purpose and intent of <br />the City's Comprehensive Plan and Title 10 of the City Code (Zoning). <br /> <br />4. The proposed variance, if granted, will not adversely affect the public health, <br />safety, or general welfare. <br /> <br />4.!l SUGGESTED CITY COUNCIL ACTION <br /> <br />4.1 By motion, approve Martin O'Connor's request for a minor variance to increase <br />reduce the side yard setback of a driveway to less than one foot to allow the <br />continuance of a driveway and parking space at 1972 Fairview Avenue North. <br />based on the findings of the Minor Variance Committee outlined in section 3.2 of <br />this report. <br /> <br />Attachments: Property location map; minor variance application; written statement from applicant; written <br />consent from adjacent property owners; sketch of property; photograph of property. <br /> <br />60-day Time Limit: Application accepted on April 17, 1998; Decision deadline is June 16,1998. <br /> <br />Prepared by: Kim L.
