<br />2.4 Access to the southern portion of the property is gained via a 20 foot access <br />easement across Lots 3 and 4, Block 2, Parranto Industrial Park (north of Abra Auto <br />Body). This access easement would continue if the property were split. <br />2.5 One of the proposed lots does not have 100 feet of frontage on a public right-of-way <br />and does not meet the requirements of Section 1007.01 (B) or Section 11 03.06(E) <br />of the City Code. It has not been the policy of the City Council to grant a waiver <br />from this requirement in the past. <br /> <br />2.5 Section 11 04.04E, City Code, outlines the procedure for a three parcel or less type <br />of minor subdivision. No hearing or Planning Commission review is necessary; <br />however, a public hearing before the City Council with prior notification of all <br />properties within 350 feet of the subject property is required. If the request is <br />approved, the final certificate of survey is reviewed by the Community Development <br />Director and then recorded with the Ramsey County Recorder. <br /> <br />Section 1007.01(8) states, "lot width shall be measured along the public right-of- <br />way line and shall not be less than 100 feet in all industrial districts." <br /> <br />Section 11 03.06(E) states that all lots shall abut on a publicly dedicated street. <br /> <br />3.0 STAFF COMMENT <br /> <br />3.1 In reviewing this request, staff made the following findings: <br /> <br />1. One of the lots created by the proposed minor subdivision does not have 100 <br />feet of frontage on a public right-of-way and does not meet the requirements <br />of Section 1007.01 (B) or Section 11 03.06(E) of the City Code. <br /> <br />2. The proposed minor subdivision is not in harmony with the general purpose <br />and intent of the City's Comprehensive Plan, Title 10 of the City Code <br />(Zoning), or Title 11 of the City Code (Subdivisions). <br /> <br />3. The proposed minor subdivision will adversely affect the public health, <br />safety, or general welfare. <br /> <br />4.0 SUGGESTED CITY COUNCIL ACTION <br /> <br />4.1 By motion, deny Hess Kline's request for a minor subdivision to subdivide a 3.68 <br />acre parcel into two parcels south of County Road C-2, based on the findings <br />outlined in Section 3.1 of this report. <br /> <br />Attachments: Location/notification map; notice of public hearing notice; proposed subdivision of property; legal <br />descriptions of existing and proposed parcels. <br />60-day Time Limit Application accepted on April 27, 1998; Decision deadline is June 26,1998. <br /> <br />Prepared by: Dennis Welsch (490-2232) and Kim L.
