Keel <br />Public Wodes Director <br />City of Roseville <br />2660 Civic Center Drive <br />Roseville, Minnesota 55113 <br /> <br />RE: Official Mapping - Twin Lakes Parkway <br />Our File No: 1011.19 <br /> <br />Dear Karl: <br /> <br />You have asked for an opinion regarding the benefits and potential exposures to the City <br />if it were to adopt an official map covering the proposed Twin Lakes Parkway right-of-way, <br />pursuant to Minnesota Statutes ~462.359. <br /> <br />The statement of purpose of the statute seems to fit precisely what you intend to <br />accomplish. Subdivision 1 of the statute reads: <br /> <br />"Land that is needed for future street purposes and as sites for other necessary <br />public facilities and services is freqently diverted to non-public uses which couid <br />have been located on other lands without hardship or inconvenience to the <br />owners. When this happens, public uses of land may be denied or may be <br />obtained later only at prohibitive cost or at the expense of dislocating the owners <br />and occupants of the land. Identification on an official map of land needed for <br />future public uses permits both the public and private property owners to adjust <br />their building plans equitably and conveniently before investments are made <br />which will make such adjustments difficult to accomplish. II <br /> <br />Officially mapping the proposed Twin Lakes Parkway right-of-way will give current property <br />owners notice of the City's intended use of the property so that those current property owners <br />can properly plan private development and expansion.
