A decision on the need for an Environmental Impact Statement (EIS)
must now be made in accordance with the standards and procedures of part 4410.1700.

An EIS must be ordered if you find that the project has the pOh~ntial for silinificant
environmental effects. In making this decision you must compare the impacts that may be
reasonablv expected to occur with the following criteria:
A. The type, extent. and reversibility of effects:
B. The cumulative potential effects of related or anticipated future projects:
C. The extent to which effects can be mitigated by ongoing public regulatory
authorities; and
D. The extent to which effects can be anticipated and controlled as a result of other
studies undertaken by public agencies or the project proposer, or of-previous EISs.

In making the EIS decision the following procedural requirements must be met:

1. The timeframe for the decision depends upon whether the decision will be made by a
single individual or by a council. board, or other body that meets only periodically. If by
an individual, the decision is to be made within 15 working days of the expiration of the
:;~:r..'T.~~t p~:-i~d.' If t.j; a bc.~J" i[,at IlIcclS uniy periodicaiiy, the decision IS to be made at
the first meeting held between three and 30 days after the close of the comment period.
These timeframes may be extended for the reason cited in item 3 below.

2. You must maintain a wrinen record of some sort, including specific findings of fact,
which supports your decision. The record must include specific responses to all
substantive, timely comments received on the EA W.

3. I f you detennine that you lack infonnation which is critical to a reasoned decision about
. the potential for or the significance of any possible environmental effects, you must
proceed in one of two ways. Either way requires a different notification process as
outlined in points 4 and 5.

=
00-
~
0=-;

-
c-
c..a

=
=
"'=

"'"
=

.,..,
.....,
.,..,
.....,

a. you must postpone the decision on the need for an E[S for up to 30 days so that you

......:.

<:r
.,....
.,....
~

=

-

n. ...
