<br />., <br /> <br />REQUEST FOR CITY COUNCIL ACTION <br /> <br />DATE: 11/09/98 <br />ITEM NO: <br /> <br />Department Approval: <br />, . <br /> <br />Agenda Section: <br />ORDINANCES <br /> <br />City of Roseville proposed text amendments to the City Code Regarding <br />Minor Variances and Setback Permits (PF3047) <br /> <br />City Manager Approval: <br /> <br /> <br />1.0 REQEUSTED ACTION <br /> <br />1.1 Hold second reading and adopt An Ordinance Amending Sections 602.06, 1012.07, <br />1013.02C, and 1014.03 and Creating Section 1013.05 of the Roseville City Code. The <br />setback permit procedure will encourages residential property owners to continue <br />investing in and upgrading their properties, while taking practical hardship into <br />consideration. The setback permit procedure as established in the ordinance will reduce <br />turn around time of requests, eliminate the need for public hearings and a finding of <br />physical hardship, reduce the cost to residents, all while adding the flexibility needed to <br />respond to Roseville's livable community goals. The ordinance will eliminate the minor <br />variance procedure and all references to minor variances throughout the code. <br /> <br />1.2 The City Council held first reading ofthis ordinance on October 26,1998. <br /> <br />2.0 BACKGROUND <br /> <br />2.1 The City Council requested the Planning Commission and staff to recommend <br />amendments to the City Code regarding minor variance procedures and establish an <br />alternative procedure to reduce setbacks in residential areas. The Council considers <br />approximately 50 minor variances and blanket minor variances annually (usually setback <br />issues), and would like an alternative to the current procedure that requires a finding of <br />physical hardship under State Statutes. In responding to the City Council's request, staff <br />proposed several alternatives, including the creation of a setback permit procedure. <br /> <br />3.0 STAFF RECOMMENDATION <br /> <br />3.1 Staff recommends amending the City Code to create an administrative setback permit <br />procedure, eliminate the minor variance procedure, and eliminate references to minor <br />variances throughout the code, as detailed in the attached ordinance. <br /> <br />4.0 PlANNING COMMISSION ACTION <br /> <br />4.1 The Planning Commission held a continued public hearing on this request on October 14, <br />1998. After a brief discussion, the Planning Commission recommended approval of an <br />ordinance amending Sections 602.06,1012.07, 1013.02C, and 1014.03 and creating Section <br />1013.05 of the Roseville City Code. <br /> <br />PF3047 - RCA (11/09/98) - Page 1 of2 <br />
