<br />as part of a previous blanket minor variance. The applicants plan to extend this <br />driveway to access the new garage. In order to access the garage from this <br />driveway, it cannot be moved further to the east unless it is moved further back on <br />the lot. If the garage is moved further back on the lot, a mature sugar maple tree <br />will need to be removed. The applicants are also concerned about maintaining the <br />aesthetic value of the open area in the rear yard of the house. The location of the <br />duplex on the property, the location of the existing driveway, and the location <br />of a mature Maple tree creates a practical difficulty for the applicants. <br /> <br />2.3 It is the policy of the City of Roseville to issue minor variances when there is a <br />hardship or practical difficulty, provided the property is located in an R-1, Single <br />Family Residential District, or R-2, Two-Family Residential District, and used for <br />residential purposes. <br /> <br />2.4 Section 1004.01, City Code, allows one major accessory building (garage) and one <br />minor accessory building (garden shed) in a residential district. This section also <br />limits the area occupied by such an accessory building to not more than 25% of the <br />required rear yard (the width of the lot x the 30 foot required rear yard setback). <br /> <br />Section 703.04(8)(9), City Code, states "residential driveways shall be constructed <br />so that the edge of the driveway nearest to the side lot line shall be a minimum of <br />five feet from the side lot line." <br /> <br />3.0 MINOR VARIANCE COMMITTEE <br /> <br />3.1 The request for the variance included the required application form, sketch of the <br />property and proposed driveway, written statement from the applicant, and written <br />approval from the adjacent property owners affected by the variance (Harvey <br />Nystrom at 190 Skillman Avenue West). <br /> <br />3.2 The Minor Variance Committee reviewed this request on Monday, May 18, 1998, <br />and unanimously recommended approval of a minor variance to reduce the setback <br />of an accessory building to three feet for the purpose of constructing a single stall <br />detached garage (14' x 22') and a variance to exceed the maximum allowed rear <br />yard building coverage to 26%, and a variance to approve a non-conforming <br />driveway at 182-184 Skillman Avenue West, based on the following findings: <br /> <br />1. The location of the duplex on the property, the location of the existing <br />driveway, and the location of a mature Maple tree creates a practical <br />difficulty for the applicants. <br /> <br />2. A blanket variance for the existing driveway was granted in 1990.
