monument sign, and directional signs. If a pylon or monument sign is used,
it must adhere to the materials palette of the building.

7. Air conditioning must be available to the entire building in order to allow the
overhead doors to remain closed in the summer. HVAC on the roof must be
screened with a 5 foot wall (as proposed).

8. Prior to a building permit being issued for redevelopment of the site, the
applicant shall post a landscape bond, letter of credit, or other security
acceptable to the City, in an amount equal to 150% of the cost of site
landscaping, street tree planting, and site restoration. The specific amount
of this security shall be determined by the Community Development Director
following completion of all site construction plans.

9. A cross parking easement with the Knight of Columbus for Knights of
Columbus overflow parking must be recorded prior to the issuance of any
building permit.

10. Any and all back assessments for this property must be paid prior to the
issuance of any building permit.

11. The applicant shall record the approved conditional use permit with the
Ramsey County Recorder prior to the issuance of any building permit or
within sixty days of approval, whichever is less (Section 1013.01-City Code).

7.0 PLANNING COMMISSION RECOMMENDA TION

7.1 The Planning Commission held a public hearing on this request on Wednesday,
June 10, 1998. Steve Johnston (Landform Engineering) and Peter Coyle (Larkin
Hoffman) were present on behalf of the applicant to answer questions and provide
additional information. Eight residents of the James Addition asked questions
and/or expressed concems with proposed development. The Planning Commission
discussed the need for a cross parking easement to accommodate the Knights of
Columbus bingo operation, the location of the trash enclosure (should be attached
to building if possible), permitted uses and conditional uses within a B-2 zoning
district, the possibility of the center median on Snelling being closed (MnDOT has
no specific plans for closure), the NTB practice of storing all tires (new and used)
within the building, legal recourse for non-compliance with the conditions of a
conditional use permit, the possibility of fencing the storm pond area since it was
next to a park, and the potential for a senior housing development in this area.

The Planning Commission recommended approval of the request for a conditional
use permit to allow the establishment of a retail auto accessory sales and service
facility at 2651 Snelling Avenue, based on the findings outlined in Section 5.1 of
this report and with the conditions outlined in Section 6.1 of this report, as amended
( 4-0).

PF3027 - RCA (06/22/98) - Page 7 of 8
