<br />public health, safety, or general welfare. The addition will be at the rear of <br />the property in area that is now a secluded and wooded area. The <br />construction of the addition will eliminate a location for youth to gather. <br />Drainage will be directed to the front of the buifding away from adjacent <br />properties and construction easements will be required. <br /> <br />3. The substandard size of the parcel (22,500 square feet) and the location of <br />the existing building on the parcel create a physical hardship for the <br />applicant, not created by the applicant. The interior layout of the building <br />also presents a practical difficulty for the applicant. <br /> <br />3.2 In reviewing the request for a sign variance, staff made the following findings: <br /> <br />1. The proposed setback variance for the replacement sign is not in harmony <br />with the general purpose and intent of the City's Comprehensive Plan and <br />Title 10 of the City Code (Zoning). There is adequate area to move back the <br />sign to a point 15 feet from the front property line without interfering with the <br />flow of traffic on the site. One parking space will be lost with the replacement <br />sign at a five foot setback or a 15 foot setback. <br /> <br />2. The proposed sign variance, if granted, may adversely affect the public <br />health, safety, and general welfare. The proximity of the sign to the right-of- <br />way may interfere with the traffic Jight located at the intersection of Lexington <br />Avenue and Roselawn Avenue. A setback of 15 feet would eliminate the <br />interference with the traffic light. <br /> <br />3. The substandard size of the parcel creates a physical hardship for the <br />applicant. Locating a sign at the required 30 foot setback would place it in <br />the middle of the drive aisle of the parking lot. <br /> <br />4.0 STAFF RECOMMENDATION <br /> <br />4.1 Based on the findings outline ;n Section 3.1, staff recommends approval of the <br />request for a variance to reduce the rear yard (east) setback to 3 feet and the side <br />yard (north) setback to 4.5 feet for the purpose of constructing an addition to an <br />. existing building (within established building lines) at 1930 Lexington Avenue North, <br />with the following provisions: <br /> <br />1. The addition must be constructed of materials and sealed or painted to match <br />those used in the original building and be designed in a manner conforming <br />to the original architecture and appearance of the existing building. (It may <br />well be that the applicant repaints the entire building to meet this provision.) <br /> <br />2. Concrete perimeter curbing must be installed in the front parking area in <br />accordance with City requirements, as directed during the re-surfacing <br /> <br />PF#3029 - RCA (08/24/98) - Page 5 of 7 <br />
