Suburban True Value will not begin construction until reaching agreement with designated representatives of Rose Villa on an acceptable landscape plan to replace the current wooded look. Suburban True Value will fund an escrow. account before construction begins to cover the cost of landscaping the area between the Rose Villa property and the hardware store. This escrow fund will be held by the property managers of Rose Villa Townhornes in the amount of $5,700, (This amount represents the cost of a satisfactory landscape plan as determined by estimates from several landscape professionals. ) The access to the construction site will be via the neighbor (business) to the immediate north of Suburban True Value, not through Rose Villa property Suburban True Value will assume responsibility for the satisfactory repair of any Rose Villa property damaged by the construction. Suburban True Value will clear twelve Dutch Elm stumps and all brush on the adjacent Rose Villa property, A sincere effort will be made to save select existing trees designated by representatives of Rose Villa Grounds Committee or Board.. Selection of paint color for the east wall of the new construction (which faces Rose Vma) will be selected by the residents of Rose Villa.
