<br />2. The proposed sign variance, if granted, may adversely affect the public <br />health, safety, and general welfare. The proximity of the sign to the right-of- <br />way may interfere with the traffic light located at the intersection of Lexington <br />Avenue and Roselawn Avenue. A setback of 15 feet would eliminate the <br />interference with the traffic light. <br /> <br />3. The substandard size of the parcel creates a physical hardship for the <br />applicant. Locating a sign at the required 30 foot setback would place it in <br />the middle of the drive aisle of the parking lot. <br /> <br />4.0 STAFF RECOMMENDA TION <br /> <br />4.1 Based on the findings outline in Section 3.1, staff recommends approval of the <br />request for a variance to reduce the rear yard (east) setback to 3 feet and the side <br />yard (north) setback to 4.5 feet for the purpose of constructing an addition to an <br />existing building (within established building lines) at 1930 Lexington Avenue North, <br />with the following provisions: <br /> <br />1. The addition must be constructed of materials as those used in the original <br />building and be designed in a manner conforming to the original architecture <br />and appearance of the existing building. <br /> <br />2. Concrete perimeter curbing must be installed in the front parking area in <br />accordance with City requirements, as directed during the re-surfacing <br />project in 1989. <br /> <br />3. Drainage on the property must be directed to the front of the property. <br />Drainage cannot be directed to adjacent properties to the north or east. <br /> <br />4. Storm water detention must be provided on site to insure that the run-off rate <br />for a 10-year event does not exceed the current run-off rate. <br /> <br />5. Temporary construction and erosion control easements will need to be <br />obtained from the property owners to the north and east in order to construct <br />the building addition. <br /> <br />6. The north and east walls of the addition must be fire rated (four hour) with <br />no openings (windows or doors). <br /> <br />7. The exterior storage of equipment being repaired must be brought into <br />compliance with the City Code (no exterior storage allowed, except for <br />display areas allowed by 1990 conditional use permit). <br /> <br />4.2 Based on the findings outlined in Section 3.2, staff recommends denial of the <br />request for a variance to reduce the setback of a pylon sign to 5 feet for the <br />purpose of replacing an existing pylon sign at 1930 Lexington Avenue North. <br /> <br />PF#3029 - RPCA (07/08/98) - Page 5 of 6 <br />
