<br />2.5 Section 1012.09 of the City Code outlines the provisions for interim uses. An <br />interim use is not required to be consistent with the land use designation identified <br />in the Comprehensive Plan, nor is it required to meet all of the zoning standards <br />established for the district in which it is located. In reviewing a request for an <br />interim use permit, the City may attach conditions and will establish a specific date <br />or event that will terminate the use on the property. In granting an interim use <br />permit, the City Council must also determine that the approval of the interim use <br />permit will not result in adverse impact on the public health and welfare, that the <br />operation is safe to the public, and that there are no additional costs added to the <br />site that would deter a permanent use at a later time. <br /> <br />3.0 STAFF COMMENT <br /> <br />3.1 In reviewing this request, staff has made the following findings: <br /> <br />1. The continued use of the existing temporary building for an additional three <br />years will not have an adverse impact on the public health and welfare. <br /> <br />2. The continued use of the existing temporary building for an additional three <br />years will not pose a threat to the public safety. <br /> <br />3. The continued use of the existing temporary building for an additional three <br />years will not deter a permanent use at a later time. <br /> <br />4.0 STAFF RECOMMENDATION <br /> <br />4.1 Based on the findings outlined in Section 3.1 of this report, staff recommends <br />approval of the request for a three-year extension of an interim use permit to allow <br />the continued use of one 24' x 70' temporary building for office space at 2701 Rice <br />Street North, with the following conditions: <br /> <br />1. The general location and appearance of the temporary building cannot be <br />changed. If the building is replaced, the appearance of any new building <br />must be compatible with the permanent structures on the property. A <br />second temporary building would not be allowed on the site without an <br />amendment to this interim use permit. <br /> <br />2. The interim use permit shall be for a period for three years and shall expire <br />on August 30, 2001. <br /> <br />5.0 SUGGESTED PLANNING COMMISSION ACTION <br /> <br />5.1 By motion, recommend approval of the request for a three-year extension of an <br />interim use permit to allow the continued use of a 24' x 70' temporary building for <br />office space at 2701 Rice Street North, based on the findings outlined in Section <br />3.1 of this report and with the conditions outlined in Section 4.1 of this report. <br /> <br />PF#3043 - RPCA (07/08/98) - Page 2 of 3 <br />
