<br />5. The Minor Variance Board may <br />recommend approval of a minor vari- <br />ance to the driveway width restrictions <br />of subsection 703.04B of this Code <br />when, in the judgment of the Minor <br />Variance Board, one or more of the <br />following conditions exist relative to <br />the driveway: <br /> <br />1013.03: TI:\IE LI "II TATI 0:\: Any action <br />by the City Council which grants <br />any conditional use permit or variance pur- <br />suant to this Chapter, heretofore or hereaf- <br />ter granted, shall expire within six (6) <br />months after the date of said action, unless <br />the applicant for such use or variance shall <br />have been granted a building permit, if <br />needed, and actually commenced construc- <br />tion or use. The applicant shall record ap- <br />proved conditional use permits or variances <br />with the Ramsey County Recorder prior to <br />issuance of any building permit or within <br />sixty (60) days after approval, whichever is <br />less. (Ord. 1176, 11-25-1996) <br /> <br />a. Unsafe conditions due to motor <br />vehicle speed or volume on or the site <br />distance from the adjacent roadway. <br /> <br />b. An unusually short distance from <br />the roadway to the garage or other <br />circumstances that prevent normal <br />maneuvering of motor vehicles within <br />the subsection 703.048, of this Code, <br />width restrictions. <br /> <br />1013.04: PROCEDURE FOR VACATI~G <br />STREET OR ALLEY: Any appli- <br />cation to vacate a street or alley shall be <br />accompanied by payment of the amount set <br />forth in Section 1014.03 of this Title and by <br />an abstractor's certified property certificate <br />showing the property owners within three <br />hundred fifty feet (350') of the street or <br />alley desired to be vacated. The application <br />shall be heard by the Planning Commission <br />procedure set forth in Chapter 108 of this <br />Code, except that the notice shall contain a <br />description of the location of the street or <br />alley to be vacated. (Ord. 1176, <br />11-25-1996) <br /> <br />c. The existing nonconforming <br />driveway provides unique structural <br />support to adjacent lands or facilities. <br /> <br />d. Other unusual conditions that <br />would result in extreme hardship ab- <br />sent the requested minor variance. <br />(Ord. 1176, 11-25-1996) <br />
