<br />unanimously approved by the Board Committee, the applicant may proceed as <br />provided in subsection B of this Section Section 1013.02, and the original fee <br />shall be applied to the fee as required for a variance. <br /> <br />1. A "minor varkmce" "setback permit" is a variance to reduction of the front, <br />side or rear yard setbacks of principal and accessory structures in either <br />R-1 or R-2 Districts or to the non motorized path'.\(ay requirements of <br />Section 1012.07 of this Title, or to the residential driveway wi€ItR <br />restrictions in subsection 703.048 of this Code. <br /> <br />2. The Minor Varianoe Bo~ud Development Review Committee shall be <br />composed of the Chief Code Enforcement Officer, the Community <br />Development Director (or designee), the Public '."lorks Director (or <br />designee), the City Manager (or designee). appointed bv the Citv <br />Manaaer. The Committee may request review of applications from other <br />Citv departments or public aaencies. <br /> <br />3. Before the Minor Vari:mce Board may consider such minor variance <br />application, the applicant shall secure and present written statements from <br />owners of property contiguous to the affected yard for which the variance <br />is requested, specifically noting whether there is objection and consenting <br />or dissenting to such minor variance. The Board shall determine the <br />adequacy and accuracy of the names and addresses of such property <br />owners. The Development Review Committee shall. in writina. seek <br />comment from contiauous property owners before considerina a reauest <br />for a setback permit. <br /> <br />4. The Minor Variance Board Development Review Committee shall <br />schedule an administrative hearing, the time and place for which shall be <br />set by the City Manager Communitv Development Director. The applicant <br />and contiguous property owners to the affected yard shall be notified Qy <br />the Community Development Director (or desianee) of such time and <br />place in writing not less than five (5) days prior to such hearing. The Gity <br />Manager Communitv Development Director (or desianee) may inform <br />additional property owners as the City Manager may feel merit an interest <br />in the proceedings. <br /> <br />5. In addition to other reauirements of this Section. the Committee. in <br />recommendina approval of a setback permit. shall find that a minimum of <br />eiaht (8) of the followina site conditions are present: <br /> <br />a. One car aaraae or less is located on the site. <br />b. The proposed proiect improves the desian or livabilitv of the <br />structure. <br />c. The proposed proiect improves the terrain or a drainaae <br />issue. <br />d. The oriainal reason or need for the setback permit was not <br />created by the current owner. <br /> <br />Ordinance _ - Page 2 of 4 <br />
