;. SectiQn 1 013.02C 1013.05. Procedure for Minor V3riance Setback Permit. A. Purpose. The purpose of the setback permit is to encouraqe residents to upqrade and improve their properties. while maintaininq the overall character of the community. B. Procedure For Minor V3ri3nce Setback Permit. An owner of land may file an application for a minor '3riance setback permit as defined in subsection 1 below by paying the fee set forth in Section 1014.03 of this Title and providinq a completed application and supportinq documents as set forth by the Community Development Department. The application shall then be referred to the Mffiaf V3ri3nce Board Development Review Committee as set forth in subsection 2 of this Section. In the event that the B03rd Committee unanimously approves said v3riance setback permit, the 'v'3riance setback permit may be granted by the GHy Council Community Development Director. In the event the application is not unanimously approved by the Board Committee, the applicant may proceed as provided in subsection B of this Section Section 1013.02, and the original fee shall be applied to the fee as required for a variance. 1:. A "minor 'J3rbnce" "setback permit" is a v~uiance to reduction of the front, ~~stcfe or rear yard setbacks of principal and accessory structures in either . R-1 or R-2 Districts or to the non motorized pathw3Y requirements of Section 1012.07 of this Title, or to the residential driveway wiGtR restrictions in subsection 703.04B of this Code. 2. The Minor 'l3riance Board Development Review Committee shall be . composed of the Chief Code Enforcement Officer, the Community Dc'.'elopment Director (or designee), the Public 'Norks Director (or designee), the City Man3ger (or designee). appointed by the City Manaqer and shall include the Community Development Director. The Committee may reauest review of applications from other City departments or public aqencies. (Current members of the Development Review Committee include the Community Development Director, Chief Code Enforcement Officer, Public Works Director (or designee), City Manager (or designee), City Planner, Park & Recreation Director (or designee), Police Chief (or designee, and Fire Marshal.) 3. Before the Minor 'lari3nce Board m3Y consider such minor vari3nce 3pplication, the applic3nt sh311 secure 3nd present 'Nritten statements from O\\'ners of property contiguous to the 3ffected Y3rd for '.vhich the vari3nce is requested, specifically noting whether there is objection and consenting or dissenting to such minor v3riance. The Board shall determine the adequ3cy 3nd accur3cy of the n3mes and 3ddresses of such property O\\'ners.
