<br />;. <br /> <br />SectiQn 1 013.02C 1013.05. Procedure for Minor V3riance Setback Permit. <br /> <br />A. Purpose. The purpose of the setback permit is to encouraqe residents to <br />upqrade and improve their properties. while maintaininq the overall character of <br />the community. <br /> <br />B. Procedure For Minor V3ri3nce Setback Permit. An owner of land may file an <br />application for a minor '3riance setback permit as defined in subsection 1 below <br />by paying the fee set forth in Section 1014.03 of this Title and providinq a <br />completed application and supportinq documents as set forth by the Community <br />Development Department. The application shall then be referred to the Mffiaf <br />V3ri3nce Board Development Review Committee as set forth in subsection 2 of <br />this Section. In the event that the B03rd Committee unanimously approves said <br />v3riance setback permit, the 'v'3riance setback permit may be granted by the GHy <br />Council Community Development Director. In the event the application is not <br />unanimously approved by the Board Committee, the applicant may proceed as <br />provided in subsection B of this Section Section 1013.02, and the original fee <br />shall be applied to the fee as required for a variance. <br /> <br />1:. A "minor 'J3rbnce" "setback permit" is a v~uiance to reduction of the front, <br />~~stcfe or rear yard setbacks of principal and accessory structures in either <br />. R-1 or R-2 Districts or to the non motorized pathw3Y requirements of <br />Section 1012.07 of this Title, or to the residential driveway wiGtR <br />restrictions in subsection 703.04B of this Code. <br /> <br />2. The Minor 'l3riance Board Development Review Committee shall be <br />. composed of the Chief Code Enforcement Officer, the Community <br />Dc'.'elopment Director (or designee), the Public 'Norks Director (or <br />designee), the City Man3ger (or designee). appointed by the City Manaqer <br />and shall include the Community Development Director. The Committee <br />may reauest review of applications from other City departments or public <br />aqencies. (Current members of the Development Review Committee <br />include the Community Development Director, Chief Code Enforcement <br />Officer, Public Works Director (or designee), City Manager (or designee), <br />City Planner, Park & Recreation Director (or designee), Police Chief (or <br />designee, and Fire Marshal.) <br /> <br />3. Before the Minor 'lari3nce Board m3Y consider such minor vari3nce <br />3pplication, the applic3nt sh311 secure 3nd present 'Nritten statements from <br />O\\'ners of property contiguous to the 3ffected Y3rd for '.vhich the vari3nce <br />is requested, specifically noting whether there is objection and consenting <br />or dissenting to such minor v3riance. The Board shall determine the <br />adequ3cy 3nd accur3cy of the n3mes and 3ddresses of such property <br />O\\'ners. The Development Review Committee shall. in writinq, seek <br />comment from contiquous property owners before considerinq a reauest <br />for a setback permit. <br /> <br />Ordinance _ - Page 2 of 5 <br />
