<br />, <br /> <br />4. <br /> <br />The Minor Vari::mce Board Development Review Committee shall <br />schedule an administrative hearing, the time and place for which shall be <br />set by the City M::mager Community Development Director. The applicant <br />and contiguous property owners to the affected yard shall be notified Qy <br />the Community Development Director (or desiqnee) of such time and <br />place in writing not less than five (5) days prior to such hearing. The Glty <br />M::m3ger Community Development Director (or desiqnee) may inform <br />additional property owners 3S the City M3nager may f-eel merit an interest <br />in the proceedings if a determination is made that such additional <br />notification is merited. <br /> <br />, ~-r <br />\),f.. f) <br />{O\~ <br /> <br />5. In addition to other requirements of this Section. the Committee. in <br />recommendinq approval of a setback permit. shall find that a minimum of <br />eiqht (8) of the followinq site conditions are present: <br />a. One car qaraqe or less is located on the site. <br />b. The proposed proiect improves the desiqn or livability of the <br />structure. <br />c. The proposed proiect improves the terrain or a drainaqe <br />issue. <br />d. The oriqinal reason or need for the setback permit was not <br />created by the current owner. <br />e. The existinq improvements alonq with proposed <br />improvement retain a minimum of 70% of the pervious <br />surface and qreen space of the lot. <br />f. The proposed proiect creates no other setback or variance <br />conditions. <br />g. The proposed proiect improves the aesthetics. covered <br />storaqe, or the functional use of the site. <br />h. The proposed proiect uses the same exterior structure <br />materials and colors as the principal structure and <br />accessories. <br />I. The final buildinq mass is consistent with that on contiquous <br />properties. <br />J. The buildinq or driveway expansion/addition does not place <br />more vehicles adiacent to livinq quarter first floor bedrooms <br />of adiacent homeowners. <br />k. The drainaqe and roof qutters quide water away from the <br />structure and adiacent structures. <br />I. The roof is properly proportioned to and inteqrated with the <br />roof of the principal structure (dwellinq) on the property. <br /> <br />6. A setback permit shall not reduce the principal structure side yard required <br />setback by more than 70% or be closer than three (3) feet to a property <br />line. <br /> <br />7.
