A setback permit shall not reduce the accessory structure side or rear yard <br />required setback by more than 70% or be closer than three (3) feet to a <br />property line. <br /> <br />9. A setback permit shall not reduce the setback of a driveway by more than <br />70% or allow a driveway to be closer than two (2) feet to a property line. <br />As an exception. driveways existinq prior to October 26. 1998. and located <br />closer than two (2) feet to a property line may be replaced with a setback <br />permit provided all other applicable provisions of the Section are met. <br />rtUlm~ <br />10. The Development Review Committee may add conditions which mitiqate <br />the impact of reduced setback to a setback permit. <br /> <br />11. <br /> <br /> <br />12. <br /> <br />If the requirements listed in this Section cannot be attained by the <br />. applicant. the variance procedure (Section 1013.02) shall apply. All <br />-eftcroachments qreater than those described in this Section shall adhere <br />to the variance procedure and shall have a demonstrated physical <br />hardship as defined by State Statute. <br /> <br />13. <br /> <br />Properties qranted setback permits under this Section shall not be allowed <br />further encroachments into the reduced setback area as allowed under <br />subsection 1012.028. <br /> <br />11. <br /> <br />The Minor V::ubnce Board may recommend 3pprov31 of 3 minor varbnce <br />to the dri'y'eway width restrictions of subsection 703.04 B of this Code <br />\\'hen, in the judgment of the Minor Variance Board, one or more of the <br />follO'.ving conditions exist relative to the driveway: <br /> <br />3. Unsafe conditions due to motor vehicle speed or volume on or the <br />site distance from the 3dj3cent r03d':.'ay. <br />b. An unusually short distance from the roadw3Y to the garage or <br />other circumstances that prevent norm31 maneuvering of motor <br />vehicles within the subsection 703.04B, of this Code, v:idth <br />restrictions. <br />c. The existing nonconforming drivel/lay provides unique structural <br />support to 3djacent lands or facilities. <br />d.
