<br />1012.02: REQUIRED YARDS AND OPEN SPACE: <br />A. Reduction Of Space Below Minimum Requirement Forbidden: No lot, yard or other open <br />space shall be reduced in area or dimension so as to make such lot, yard or open space less <br />than the minimum required by this Title, and if the existing lot, yard or other open space as <br />existing is less than the minimum required, it shall not be further reduced. No required open <br />space provided about any building or structure shall be included as a part of any open space <br />required for another building or structure. (Ord. 275, 5-12-1959) <br /> <br />B. Certain Structures Not Considered Encroachments: The following shall not be considered as <br />encroachments on yard setback requirements: <br /> <br />1. Chimneys, flues, belt courses, leaders, sills, pilasters, lintels, ornamental features, <br />cornices, eaves, gutters and the like provided they do not project more than three feet (3'). <br />(Ord. 275, 5-12-1959) <br /> <br />2. Terraces, steps, uncovered porches and patios, decks, stoops or similar features provided <br />they do not extend above the height of the ground floor level of the principal structure or <br />to a distance less than two feet (2') from any lot line except that patios shall not be less <br />than ten feet (10') from a street right of way. Fences in front yards which do not exceed <br />four feet (4') in height. <br /> <br />3. Side Or Rear Yard Only: Bays not to exceed a depth of three feet (3') or contain a gross <br />area of more than thirty (30) square feet, fire escapes not to exceed a width of three feet <br />(3') and fences or walls not to exceed a height of six and one-half feet (6 1/2') above grade <br />except that in B or I Districts or on property lines in other districts abutting B or I <br />Districts;"fences or walls shall not exceed eight feet (8') above grade. (Ord. 878, <br />3-23-1981; amd. 1995 Code) <br /> <br />4. Rear Yard Only: Balconies, breezeways, detached outdoor picnic shelters and <br />recreational equipment. (Ord. 275, 5-12-1959) <br /> <br />C. Fences: <br /> <br />1. Location: Fences, when constructed to enclose any lot or tract of land, shall be located in <br />such a way that the entire fence shall be on the property of the builder thereof. Posts and <br />framework shall be placed within the property lines of the owner and the actual fencing <br />material such as wire, lumber, pickets, etc. shall be placed on the side of the fence which <br />faces the street or the adjacent property. (1990 Code) <br /> <br />2. Barbed Wire Fences Prohibited: No fence constructed with or using barbed wire shall be <br />permitted in any R District or on any property line which abuts an R District.
