<br />shall be included as a part of any open space required for another building or structure. (Ord. 275, 5-12- <br />1959) <br />B. Certain Structures Not Considered Encroachments: The following shall not be considered as <br />encroachments on yard setback requirements: <br />I. Chimneys, flues, belt courses, leaders, sills, pilasters, lintels, ornamental features, cornices, eaves, <br />gutters and the like provided they do not project more than three feet (3'). (Ord. 275, 5-12-1959) <br />2. Terraces, steps, uncovered porches and patios, decks, stoops or similar features provided they do <br />not extend above the height of the ground floor level of the principal structure or to a distance less than two <br />feet (2') from any lot line except that patios shall not be less than ten feet (10') from a street right of way. <br />Fences in front yards which do not exceed four feet (4') in height. <br />3. Side Or Rear Yard Only: Bays not to exceed a depth of three feet (3') or contain a gross area of <br />more than thirty (30) square feet, fire escapes not to exceed a width of three feet (3') and fences or walls not <br />to exceed a height of six and one-half feet (6 II2') above grade except that in B or I Districts or on property <br />lines in other districts abutting B or I Districts, fences or walls shall not exceed eight feet (8') above grade. <br />(Ord. 878,3-23-1981; amd. 1995 Code) <br />4. Rear Yard Only: Balconies, breezeways, detached outdoor picnic shelters and recreational <br />equipment. (Ord. 275, 5-12-1959) <br />C. Fences: <br />I. Location: Fences, when constructed to enclose any lot or tract of land, shall be located in such a <br />way that the entire fence shall be on the property of the builder thereof. Posts and framework shall be <br />placed within the property lines ofthe owner and the actual fencing material such as wire, lumber, pickets, <br />etc. shall be placed on the side of the fence which faces the street or the adjacent property. (I 990 Code) <br />2. Barbed Wire Fences Prohibited: No fence constructed with or using barbed wire shall be permitted <br />in any R District or on any property line which abuts an R District. (Ord. 878, 3-23-81) <br /> <br />602.06: PARKING ON BOULEVARD PROHIBITED: <br />No vehicle shall be parked on any boulevard adjacent to a public street except: <br />A. Boulevard parking spaces listed on the inventory of boulevard parking spaces regularly in use, <br />dated June 30, 1984, prepared by the Code Enforcement Officer, a copy of which is incorporated herein by <br />reference and which is on me in the office of the City Manager, may continue to be used until one of the <br />following occurs: <br />I. Roadway improvements involving disturbance of or removal of the boulevard parking area is <br />undertaken; or <br />2. Substantial improvements to the lot located adjacent to the boulevard parking area is undertaken, <br />such expansion or construction of house, garage or driveway. <br />B. Where a variance from the provisions of this Section is granted pursuant to the minor variance <br />procedure of subsection 1013.02C of the City Code, based upon criteria established by the City <br />Manager. (Ord. 962,9-10-84) <br /> <br />1012.07: NONMOTORIZED PATHWAYS REQUIRED: <br />A. On all properties which are on the City's official, norunotorized pathway system established by <br />resolution of the City Council and on all tax exempt property and B-1 through B-4 and shopping center <br />zoned properties, regardless of whether or not they are on the official pathway system, where there is new <br />building construction or renovation where the renovation value is fifty percent (50%) or more of the <br />prerenovation value of the structure, norunotorized pathways shall be constructed by the property owner in <br />public right of way, at a place prescribed by the Public Works Director. Excepted from this requirement are <br />nontax exempt R-I and R-2 properties. <br />B. In lieu of construction of a norunotorized pathway described herein, the property owner may pay <br />to the City an amount equal to the cost of the norunotorized pathway to satisfy the obligations of this <br />Section. Said payment shall be used by the City to further maintain and construction of the norunotorized <br />pathway system within the City. <br />C. A property owner seeking a variance from the requirement of this Section may apply for such <br />variance pursuant to the minor variance procedures of subsection 1013 .02C.
