REQUEST FOR COUNCIL ACTION

DATE: 09/28/98
ITEM NO: C-l
Agenda Section:
CONSENT

1.0 REQUESTED ACTION

1.1 Carol Moss is requesting a 60-day extension to the deadline for recording a minor
subdivision for a parcel at 2207 County Road 8 West, from September 28, 1998,
to November 28, 1998.

2.0 BACKGROUND

2.1 On July 27,1998, the City Council approved a minor subdivision to allow a 0.6 acre
parcel located at 2207 County Road 8 West (corner of County Road 8 West and
Marion Road) to be split into two 13,068 square foot lots.

2.2 Section 1104.04(E) of the City Code requires approved subdivisions of this type to
be recorded with the Ramsey County Recorded within 60 days of approval of the
certificate of survey. Since the certificate of survey for this subdivision was
submitted in conjunction with the application, the 60 days started the day after
approval by the City Council.

2.3 Ms. Moss has placed the properties on the market and has had several potential
buyers who are interested in keeping the parcels together. If the minor subdivision
is recorded and the ultimate buyer wishes to keep the two parcels together, an
additional City action will be required to combine the two new parcels back into the
original 0.6 acre parcel. For this reason, Ms. Moss is requesting a 60-day extension
of the recording deadline.

2.0 SUGGESTED CITY COUNCIL ACTION

2.1 By motion, extend the deadline for recording the minor subdivision of property at
2207 County Road 8 West for 60-days, from September 28, 1998, to November 28,
1998.

Attachments: Letter from Carol Moss; excerpt of July 27, 1998, City Council minutes; approved lot split.
Prepared by: Kim L.
