<br />commission or broker fee being due pursuant to this sale; then the party so entering into the <br />agreement shall be responsible for the payment of any real estate commission or broker fee <br />arising thereunder and shall hold the other party harmless from such real estate commission or <br />broker fee. . <br /> <br />16. BINDING EFFECT. The terms of this Contract shall run with the land and bind the parties <br />hereto and their successors in interest. <br /> <br />17. HEADINGS. Headings of the paragraphs of this Contract are for convenience only and do not <br />define, limit or construe the contents of such paragraphs. <br /> <br />18. ADDITIONAL TERMS: <br /> <br />(a) DEFINITIONS. <br /> <br />"Construction Plans" means the plans, specifications, drawings and related documents <br />showing the construction work to be performed on the Property which shall include at <br />least the following; (a) site plal1, (b) landscape plan, (c) grading, drainage and erosion <br />s()ntrol plan, (d) foundation plan, - (e) basement plan, (1) floor plan for each floor, (g) <br />el~vations (all sides), and (h) demolition plan including a statement as to where the <br />d,epris from such demolition is to be trahsporJed if demolition of an existing structure or <br />imp:?VemeIlt is required, <br /> <br />"Minimum Improvements" means the construction of a 2,000 square foot -1...bedroom <br />two story single family residential home, including -L bathrooms and a..l...- car <br />garage, which when completed, the Property and Minimum Improvements will have an <br />estimate market value of $ 200,000 as determined by Ramsey County Assessor's <br />office. <br /> <br />"Unavoidable Delays" means delays beyond the reasonable control of the party seeking to <br />be excused as a result thereof which are the direct result of strikes, other labor troubles, <br />prolonged adverse weather or acts of God, fire, or other casualty to the Minimum <br />Improvements. In the event of an Unavoidable Delay, the applicable performance date <br />shall be extended one (1) day for each one (1) day during which the Unavoidable Delay <br />exists. <br /> <br />(b) CONSTRUCTION PLANS. Within ten (10) days following the execution of this Contract. <br />the Purchaser shall deliver to the Seller the Construction Plans. The Construction Plans <br />shall provide for the construction of the Minimum Improvements on the Property in a <br />[rI!anner which complies with this Contract, the .Housing Design and Site Criteria as/ <br />attached in exhibit "A" of the HRP GuideliIles", and all applicable laws and regulations. <br />. In the event that demolition of existing structures or improvements on the Property will <br />be required to construct the Minimum Improvements, then a demolition plan (including <br />a description of where the debris is to be disposed ot) must also be submitted to the Seller <br />~s ~ part of the Construction Plans. <br /> <br />Once submitted, the Seller shall review the Construction Plans with the objective of <br />promoting the health, safety, welfare and aesthetic character of the Seller as determined <br />by the Seller.
