MN 55432 <br /> <br />Dear Peter: <br /> <br />In October of 1998, the City of Roseville sent a request for proposal to over 60 homebuilders for <br />the purchase of property located at 2190 St. Croix Street in the City of Roseville under the <br />Housing Replacement Program (HRP). The City received a proposal and signed Participation <br />Agreement from Preferred Builders dated October 26,1999. The participation agreement <br />included the exclusive right to negotiate with the City on a redevelopment contract by <br />submitting a non-refundable check for $500. The participation agreement, per the HRP, <br />expires within 60-days. <br /> <br />During the 60-day exclusive negotiation period, the City and Preferred negotiated terms and <br />conditions of a Contract for Deed (Contract) which was prepared by the City of Roseville and <br />reviewed and agreed upon by Preferred Builders. The Roseville City Council approved the <br />. Contract on November 23, 1998. <br /> <br />Upon execution ofthe Contract, the Buyer (Preferred Builders) has 10 days to submit building <br />plans to the City for approval based upon the terms and conditions outlined in the Contract. <br />To date, the Contract has not been executed by Preferred Builders, which is in "iolation ofthe <br />60-day Participation Agreement. The City of Roseville, in good faith, has been patient with <br />Preferred Buildings regarding its exclusive right to negotiate on the sale of 2190 St. Croix Street <br />and has not negotiated with other builders. <br /> <br />This letter will serve as notice to Preferred Builders that the Contract, as attached, must be <br />executed by May 1,1999 or the City will exercise its right to terminate the Participation <br />Agreement regarding the Exclusive Right to Negotiate. If this right is terminated, the City will <br />refund Preferred Builders for its cost to demo the structure located at 2190 St. Croix upon <br />submission of an invoice for the cost up to $5,500 per the signed Waiver of Trespass <br />Agreement. <br /> <br />2660 Civic Center Drive .:.
