<br />2.2 The required rear yard of the property is 1,800 square feet; therefore, the maximum <br />allowed for a detached garage area is 450 square feet (25% of the required rear <br />yard). The existing detached 15' x 22' square foot garage is 330 square feet in area <br />(18.3% of the required rear yard) and the proposed 26' x 26' replacement garage <br />IS 676 square feet in area (37.6% of the required rear yard). <br /> <br />2.3 Section 1004.01 (A), City Code, states that an accessory building cannot occupy <br />more than 25% of the required rear yard (width of lot x 30' required rear yard depth). <br /> <br />Section 704.04(B) requires a minimum driveway setback of 5' from the side lot line. <br /> <br />Section 1013.02 outlines the procedure for considering a variance. <br /> <br />3.0 STAFF COMMENT <br /> <br />3.1 In reviewing this request, staff made the following findings: <br /> <br />1. Section 1004.01 (A) of the City Code limits the size of an accessory building <br />to 25% of the required rear yard, which limits the size of a detached garage <br />on this property to 450 square feet. The proposed garage will be 676 square <br />feet in area (37.6% of the required rear yard). <br /> <br />2. The pre-existing, non conforming width of the parcel creates a physical <br />hardship for the applicant; it limits the size of an accessory building to 450 <br />square feet. (A standard, newly created lot would be 85 feet in width and <br />allow for approximately 635 square feet of accessory buildings.) The <br />substandard width of the parcel also creates a practical difficulty in 109ating <br />a driveway to access a detached garage. <br /> <br />3. The proposed variance is in harmony with the general purpose and intent of <br />the City's Comprehensive Plan and Title 10 of the City Code (Zoning). The <br />location of the house on the parcel and the interior design of the house <br />prohibits the construction of an attached garage of any size. The proposed <br />replacement garage will be setback the required five feet from the western <br />property line (existing garage is set back 3 feet). <br /> <br />4. The proposed variance, if granted, will not adversely affect the public health, <br />safety, or general welfare. <br /> <br />4.0 STAFF RECOMMENDA TION <br /> <br />4.1 Based on the findings outlined in Section 3.1, staff recommends approval of the <br />request for a variance to increase the lot coverage to 37.5% of the required rear for <br /> <br />PF3057 - RCA (08/24/98) - Page 2 of 3 <br />
