Approve 701 Emerald Ridge Encroachment Agreement <br /> At the request of Mayor Roe, City Manager Trudgeon briefly reviewed this re- <br /> quest as detailed in the RCA dated August 25, 2014. <br /> Councilmember Laliberte again expressed her general support for moving for- <br /> ward with this request; however, as noted in the RCA (lines 14 — 18), she ques- <br /> tioned if agreements were in place for those other encroachment areas. <br /> City Manager Trudgeon responded that staff had been unable to determine how <br /> and why agreements had not been done as part of the permitting process for exist- <br /> ing structures encroaching on the easement; but as mentioned during his initial <br /> summary, staff would be following up to determine if the current easement width <br /> was necessary, or could be reduced to eliminate the need for pursuing agreements <br /> with all affected property owners. Short of that, Mr. Trudgeon advised that struc- <br /> tures were not allowed on easements and would need to be removed as applicable <br /> to ensure access by the City to infrastructure as needed. <br /> Councilmember Laliberte opined that there should be some standardization and <br /> fairness applied for all property owners. <br /> City Manager Trudgeon noted that this request had been prompted due to the ur- <br /> gency of the homeowner to build a deck during this construction season, and as <br /> part of the permitting process, the situation had been discovered and was intended <br /> for resolution, along with issues at adjacent properties. <br /> Mayor Roe opined that, with respect to fairness, since the background was un- <br /> known, staff was attempting to resolve the situation now on one way or another. <br /> At the request of Councilmember Willmus, City Engineer Mark Culver addressed <br /> the depth of sanitary sewer service in this area; with Councilmember Willmus <br /> noting that the deeper the lines, the wider easement area needed. <br />
