<br />various tools for home maintenance. The proposed accessory building will be <br />accessed from Skillman Avenue, with one 16 foot wide door and one 9 foot wide <br />door facing the roadway. The site plan as submitted also shows a 36 foot wide curb <br />cut; however, the City limits the width of residential curb cuts to 26 feet. <br /> <br />2.3 The required rear yard of the property is 2,250 square feet; therefore, the maximum <br />allowed for a detached garage area is 562.5 square feet (25% of the required rear <br />yard). The proposed 28' x 36' garage is 1008 square feet in area (44.8% of the <br />required rear yard). <br /> <br />2.4 Section 1004.01 (A), City Code, states that an accessory building cannot occupy <br />more than 25% of the required rear yard (width of lot x 30' required rear yard depth). <br /> <br />Section 1013.02 outlines the procedure for considering a variance. <br /> <br />3.0 STAFF COMMENT <br /> <br />3.1 In reviewing this request, staff made the following findings: <br /> <br />1. Section 1004.01 (A) of the City Code limits the size of an accessory building <br />to 25% of the required rear yard, which limits the size of a detached garage <br />on this property to 562.5 square feet. The proposed garage will be 1008 <br />square feet in area (44.8% of the required rear yard). <br /> <br />2. The pre-existing, non conforming width of the parcel creates a physical <br />hardship for the applicant; it limits the size of an accessory building to 562.5 <br />square feet. (A standard, newly created lot would be 85 feet in width and <br />allow for approximately 635 square feet of accessory buildings.) The fact that <br />the lot is a through lot also creates a physical hardship for the applicant, in <br />that it limits the location of an accessory building to the side yard area. <br /> <br />3. The proposed variance is not harmony with the general purpose and intent <br />of the City's Comprehensive Plan and Title 10 of the City Code (Zoning). <br />While Skillman Avenue is the rear yard of this property, numerous single <br />family home~ to the north front on Skillman Avenue. For this reason, <br />a 1008 square foot garage in this location will have an adverse impact <br />on the residential character of Skillman Avenue. In addition, the area of <br />. the proposed garage (1008 square feet) combined with the area of the <br />existing attached garage (360 square feet) exceeds the main floor living area <br />of the house (1165 square feet). <br /> <br />4. The proposed variance, if granted, will not adversely affect the public health, <br />safety, or general welfare. <br /> <br />PF3058 - RCA (08/24/98) - Page 2 of 4 <br />
