<br />been unlimited access from the service road to properties in this area (no defined <br />curbcuts) and the six parking spaces in the front of the building are accessed <br />directly from the service road. The other spaces on the property are accessed by <br />crossing over adjacent properties. <br /> <br />2.4 The City is currently undertaking a roadway improvement project in this area. As <br />part of the project, curbing is being installed and access to adjacent properties is <br />being brought into compliance with City requirements. If the curbcut on this <br />property is reduced to 36 feet, two of the six parking spaces will be lost. For this <br />reason, Ms. Wild is requesting a variance to increase the width of the curbcut in <br />order to retain all six spaces. The parking spaces will continue to extend more than <br />20 feet onto the property; therefore, parking on the right-of-way will not be an issue. <br /> <br />2.5 On-street parking is available along the west side of the service road. It appears <br />that patients and clients visiting this building park in this area. <br /> <br />2.6 Section 703.04(8)(1) of the City Code allows a maximum curbcut width of 36 feet <br />for nonresidential properties. <br /> <br />Section 1013.02 outlines the procedure for considering a variance. <br /> <br />3.0 STAFF COMMENT <br /> <br />3.1 In reviewing this request, staff made the following findings: <br /> <br />1. Section 703.04 (8)(1) limits the width of a non-residential curbcut to 36 feet <br />in non-residential areas. The property has historically had unlimited access <br />from the service road and six parking spaces at the front of the building. If <br />the curbcut is installed at a width of 36 feet, two of these parking spaces will <br />be lost. <br /> <br />2. The substandard width and size of the parcel creates a physical hardship for <br />the applicant. The substandard size of the parcel also presents a practical <br />difficulty in providing adequate off-street parking on the site. <br /> <br />3. The proposed variance is in harmony with the general purpose and intent of <br />the City's Comprehensive Plan and Title 10 of the City Code (Zoning). The <br />proposed increase in curbcut width will allow the continued use of the six <br />parking spaces and alleviate parking problems in the area. <br /> <br />4. The proposed variance, if granted, will not adversely affect the public health, <br />safety, or general welfare. The Engineering staff has agreed that this is an <br />unusual situation and will not adversely affect flow of traffic or traffic safety <br />in this area. <br /> <br />PF3059 - RCA (09/14/98) - Page 2 of 3 <br />
