The Minor Variance Committee concurred <br />that the proposed replacement garage is the best option from both a <br />functional and aesthetic standpoint. <br /> <br />3.3 The Minor Variance Committee unanimously recommended approval of a minor <br />variance to allow the placement of an accessory building in the front yard area of <br />a parcel at 2255 Cleveland Avenue North, based on the following findings: <br /> <br />1, Section 1004.02(0)(4) requires a front yard setback of no less than 30 feet. <br /> <br />2. Section 1004.01 (A) requires accessory buildings to be placed in the rear <br />yard. Although the proposed location of the garage is in the rear yard area <br />of the property based on the orientation of the house, it is in the front yard <br />based on the definitions found !n the City Code. <br /> <br />3. The topography of the parcel, the location of the san itary sewer service, the <br />wooded nature of the parcel, and the location of the house on the property <br />creates a physical hardship for the applicant. <br /> <br />4. 1t is the policy of the City to encourage reinvestment in residential properties <br />throughout the community. <br /> <br />5. The proposed variance is in harmony with the general purpose and intent of <br />the City's Comprehensive Plan and Title 10 of the City Code (Zoning), <br /> <br />6. The proposed variance, if granted, will not adversely affect the public health, <br />safety, or general welfare. <br /> <br />4.0 SUGGESTED CITY COUNCIL ACTION <br /> <br />4,1 By motion, approve Jeff & Trudi Martinco's request for a minor variance to allow the <br />placement of an accessory building in the front yard area of a property at 2255 <br />Cleveland Avenue North, based on the findings of the Minor Variance Committee <br />outlined in section 3.3 of this report. <br /> <br />Attachments: Property location map; written statement from applicant; written consent from adjacent property <br />owners; sketch of property; proposed building elevation: photographs of property. <br /> <br />60.day Time limit: Application accepted on July 20,1998; Decision deadline is September 18, 1998. <br /> <br />Prepared by: Kim L.
