REQUEST FOR COUNCIL ACTION

DATE: 09/14/98
ITEM NO: c- 2

Item Description:

Mana~r ~roved: Agenda Section:
~8- CONSENT

Sharon Leete request for a mi,nor variance to reduce the side yard
setback of a driveway to one foot at 801 Lovell (PF#3069).

Department Approval:

1.0 REQUESTED ACTION

1.1 Sharon Leete is requesting a minor variance to reduce the side yard setback of a
driveway to one foot for the purpose of constructing an eight foot (8') wide asphalt
parking pad to allow for additional vehicular parking at 801 Lovell.

Requirement

Proposal

Variance

Side yard setback - 5'

l' setback

4' variance

2.0 BACKGROUND

2.1 Sharon Leete, on July 7, 1998, received a letter from the City's Codes Coordinator
indicating that she was in violation of Section 407.02M of the Roseville City Code
by allowing a vehicle to be parked on the grass in her yard at 802 Lovell.

2.2 In an effort to comply with City Code requirements, Ms Leete contacted a contractor
to determine the feasibility adding a parking pad to allow for an area for her
daughter to park. As the home has only a single car garage, the lack of
adequate space for both vehicle movement and parking creates a practical
difficulty for the applicant.

2.3 It is the policy of the City of Roseville to issue minor variances when there is a
hardship or practical difficulty, provided the property is located in an R-1, Single
Family Residential District, and used for residential purposes.

2.4 Section 407.02M(3)a of the City Code, requires that "Vehicles which are parked or
stored outside shall be on an improved surface..." and Section 1 004.01 D
determines the setback requirements to be not less than five feet from all lot lines
of adjoining lots.

3.0 MINOR VARIANCE COMMITTEE

3.1 The request for the variance included the required application form, sketch of the
property and proposed driveway pad, written statement from the applicant, and

PF#3025 - RCA (05/26/98) - Page 1 of 2
