<br />n. ~0''t~ <br /> <br />City Of Roseville <br />Planned Unit Development Agreement =##: 1222 <br /> <br />AGREEMENT, dated May 24,1999, between the City of Roseville, a Minnesota municipal corporation <br />(herein referred to as "CITY"), and Speedway SuperAmerica, L.L.C., Springfield, Ohio. 45501, referred <br />to as "DEVELOPER"). <br /> <br />1.0 Effective Date of Agreement <br /> <br />This agreement shall be effective upon completion of the following: 1) passage and publication of <br />Ordinance # 1222 (Rezoning of Property to PUD); 2) publication of the ordinance in the CITY's official <br />newspaper; 3) execution of this agreement by the CITY and the DEVELOPER; and 4) recording of this <br />agreement with Ramsey County. <br /> <br />2.0 Request for Planned Unit Development Approval <br /> <br />The DEVELOPER has asked the CITY to approve a Planned Unit Development (PUD) (PF#3073) that <br />redevelopes an existing 2,014 square foot gas/convenience use into a 2,865 square foot convenience <br />store and a canopy area consisting of five (5) gas dispensers within two service islands. The property <br />is legally described as follows: <br /> <br />2785 Hamline Avenue North (PID 032923310025) City of Roseville, Ramsey County. <br />Minnesota, legally described as follows: <br /> <br />The north 150 feet of the south 300 feet of the east 173 feet of the Northeast Quarter <br />of the Southwest Quarter, subject to street and avenue, Section 3, Township 29, Range <br />23, Ramsey County, Minnesota. . <br /> <br />5.0 Planned Unit Development Approval <br /> <br />The CITY hereby grants approval of the final development plan for Speedway SuperAmerica, subject <br />to the DEVELOPER's compliance with the terms and conditiO'ns of this agreement. The CITY agrees <br />to approve applications for building permits. provided that said plans are consistent with the exhibits <br />which were approved at the concept and final stage of the Planned Unit Development process the <br />DEVELOPER has not defaulted, and all of the standards and conditions of this agreement have been <br />satisfied. <br /> <br />For three (3) years from the date of this Agreement, no amendments to the CITY'S Comprehensive <br />Guide Plan or official controls shall apply to or affect the use, development density, site layout, or <br />dedication requirements of the land included within the Planned Unit Development unless required <br />by state or federal law or agreed to in writing by the CITY and the DEVELOPER. For any <br />improvements proposed thereafter, notwithstanding anything in this Agreement to the contrary, the <br />CITY may require compliance with any amendments to the City's Comprehensive Guide Plan, official <br />controls, platting or dedication requirements enacted after the date of this Contract. <br /> <br />1 <br />
