4.0 Approval by the CITY In approving the final development plan for the PUD for Speedway SuperAmerica, the CITY hereby incorporates the following exhibits. The DEVELOPER shall develop the subject property as described or shown in these exhibits. If the exhibits vary from the written terms of this Agreement, the written terms shall control. In the event the exhibits address items not specifically addressed in this agreement, the exhibits shall govern with respect to those items~ The exhibits marked as approved by the City Council on May 24, 1999, or as amended thereafter, shall include: EXHIBIT A Certificate of Survey of the existing property including structure, canopy and gas pump island and other land features, dated July 9, 1998. EXHIBIT B Site development plan that includes property boundary, structure location (including the trash enclosure), curbing. canopy and gas pump islands, and sign location, dated March 11, 1999. EXHIBIT C Grading plan illustrating existing grades and those proposed after completion of the proposed construction, drainage directions, spot elevations, catch basins for surface water catchment, dated March 16, 1999. EXHIBIT D Utility plan indicating sanitary sewer, watermain. gas, electric. and storm sewer connection, dated March 11, 1999. EXHIBIT E Site lighting plan including specifications, lighting calculations for parking lot, canopy and structure, dated March 11, 1999. EXHIBIT F Complete Landscape Plan including materials list, sizes, and locations of all plant materials dated May 21, 1999. EXHIBIT G Building floor plan with dimensions of the interior facility. dated September 10.1998. EXHIBIT H Building elevations, with dimensions and materials identified, dated September 9, 1998. EXHIBIT I Canopy plan including elevation drawings and gas pump island design.
