If the Concept plan is approved, the PUD would be written to allow a <br />gasoline/convenience store with the underlying z<?ning being Limited Retail (B-2) and the <br />setback reductions. and sign height proposed in the attached plans. <br /> <br />3.14. The project as proposed is in harmony with the general purpose and intent of the City's <br />Comprehensive Plan and Title 10 of the City Code (Zoning). <br /> <br />3.15. The proposed project will not adversely affect the public health, safety, or general <br />welfare. <br /> <br />3.16. To address the issue/impact regarding hours of operation, staff would recommend that the <br />following language be incorporated into the final planned unit development document: <br />The operation of the subject parcel for a convenience store and motor (gas) fuel sales site <br />shall be limited to 6 .am. to 12 midnight on Sunday through Thursday and 6 a.m. to 1 :00 <br />a.m. on Friday and Saturday. The Community Development Director shall review thyse <br />hours of operation within 18 months of the date the new facility opens, with a report <br />being submitted to the Planning Commission and City Council. Based on findings o'f this <br />report (which include parking traffic, noise, light, and any police record) the City Council <br />may modify (increase or decrease) the hours of operation. <br /> <br />4.0 STAFF RECOMMENDATION <br /> <br />4.1 Based on the findings outlined in Section 3 of this report, staff recommends approval of <br />the concept development plan for a business planned unit development (B-PUD) that <br />allows the construction of a 2,867 s.f. convenience structure with a gas pump service <br />area. <br /> <br />5.0 PLANNING COMMISSION ACTION <br /> <br />On April] 4, 1999, the Roseville Planning Commission held the required public hearing <br />regarding the subject request, at which hearing the discussion took place regarding use as <br />a 24 hour facility. Ross Jacobson, ] 382 Judith, expressed concern over site lighting and a <br />24 hour operation. Norm Nelson, representative for Hamline House, expressed support <br />from the residents for a 24 hour facility. <br /> <br />The City of Rosevil1e Planning Commission recommended (6-0) to approve of the <br />Speedway SuperAmerica request for a concept development plan for a business planned <br />unit development (B-PUD) allowing the redevelopment of the existing convenience store <br />and gas pump island area, based on the findings and conditions (3.5 through 3.15) listed <br />in Section 3 of the Request for Commission Action dated 4/14/99 and including a <br />condition regarding no outdoor storage. <br /> <br />PF3073 - HCA (04-26-99) Page 5 of 6 <br />
