<br />REQUEST FOR COUNCIL ACTION <br /> <br />DATE: 04.12.99 <br />ITEM NO: J-4 <br /> <br /> <br />Requestfor Spring and all 1999 Garage Sale Permit, YMCA <br />(PF3074) <br /> <br /> <br />AQenda Section: <br />Land Use <br /> <br />ent Approval: <br /> <br />1.0 Background: <br /> <br />The YMCA has requested approval of a spring garage sale set up and sale promotion <br />permit for Wednesday, May 19th through Sunday, May 23rd, 1999 and, for their fall <br />garage sale for Wednesday, September 22nd through Sunday, September 26th, at 1170 W. <br />County Road B. The requested set-up for the spring sale will begin Saturday, May 16th, <br />and the set-up for the fall sale will begin Saturday, September 18th. <br /> <br />1.1 The City Code, Section 1004.01 I (attached), states that a normal residential garage sale <br />may be up to 3 days long, three times during anyone calendar year. The sale must be <br />held between the hours of 8:00 am and 6:00pm. For garage sales/promotions that will <br />vary from those standards, the Code requires Council approval. <br /> <br />The YMCA Sale varies in the following ways: <br /> <br />1) It is longer than 3 days of sales; <br /> <br />2) The set-up period will begin three to six days prior to the sale. <br /> <br />3) Because of the magnitude of the garage sale promotions, a portion of the <br />items for sale will most likely be stored on the yard, not within the garage or <br />screened areas. <br /> <br />1.2 On September 14, 1998, the last time a garage sale request was submitted by the YMCA, <br />the Council expressed concern about this event due to concerns for the health and safety <br />of persons attending the sale. Although the no-parking designation on the north side of <br />County Road B during the sale helps considerably, some of the Council members <br />preferred that the YMCA find a more suitable site for the sales. <br /> <br />2.0 Staff Findine:s and Recommendations: <br /> <br />From the staff perspective, the YMCA Sale/Promotion has been so successful that it has <br />outgrown the intent of the residential garage sale section of the code.
