<br />'" <br /> <br />REQUEST FOR COUNCIL AUION <br /> <br />DATE: 04.12.99 <br />ITEM NO: <br /> <br />Department Approval: <br /> <br />Manager Approved: <br /> <br />Agenda Section: <br />Consent <br />Item Description: APPROVAL OF SPRING AND FALL, 1999 YMCA GARAGE SALE <br /> <br />Background: The YMCA has requested approval of a spring garage sale set up and sale <br />promotion permit for Wednesday, May 19th through Sunday, May 23rd,1999. and, for their fall <br />garage sale for Wednesday, September 22nd through Sunday, September 2611>, at 1170 W. County <br />Road B. The requested set-up for the spring sale will begin Saturday, May 1611>, and the set-up <br />for the fall sale will begin Saturday, September 1811>. <br /> <br />The City Code, Section 1004.01 I (attached), states that a normal residential garage sale may <br />be up to 3 days long, three times during anyone calendar year. The sale must be held between <br />the hours of 8:00 am and 6:00pm. For garage sales/promotions that will vary from those <br />standards, the Code requires Council approval. <br /> <br />The YMCA Sale varies in the following ways: <br /> <br />1) It is longer than 3 days of sales; <br /> <br />2) The set-up period will begin three to six days prior to the sale. <br /> <br />3) Because of the magnitude ofthe garage sale promotions, a portion ofthe <br />items for sale will most likely be stored on the yard, not within the garage <br />or screened areas. <br /> <br />On September 14,1998, the last time a garage sale request was submitted by the YMCA, the <br />applicant was asked to seek another location for this event due to concerns for the health and <br />safety of persons attending the sale. Although the no-parking designation on the north side of <br />County Road B during the sale helps considerably, some of the Council preferred that the <br />YMCA find a more suitable site for the sales. <br /> <br />From the staff perspective, the YMCA Sale/Promotion has been so successful that it has <br />outgrown the intent of residential garage sale section of the code. It has become more of a <br />biannual sale/celebration. The purposes of the YMCA Sale/Promotion are unique and valid: <br />the location of such a community event should be reevaluated in the future. There should be <br />some method in which community organizations and the city can jointly find a more <br />appropriate location for such events.
