<br />4.1 Based on the findings outlined in Section 3.1, staff recommends approval of the request <br />for a variance from Section 1004.02(D) of the City Code to reduce the width of two single <br />family residential lots from 85 feet to 64 feet for the purpose of splitting a 38,238 square <br />foot parcel with 128.31 feet of frontage into two parcel at 1027 Shryer Avenue West and <br />a variance to reduce the side yard setbacks to five feet, with the following provisions: <br /> <br />1. The existing structure on the parcel must be removed prior to construction of <br />either new home on the site. <br /> <br />2. Separate water and sanitary sewer services must be provided for each parcel. <br /> <br />3. Each new home must be setback a minimum of 50 feet from the front property line, <br />be similar in scale and mass to the concept plan submitted in conjunction with the <br />request for a variance, and include a two car garage. The site plan for the eastern <br />parcel must be modified to place the garage on the eastern side of the parcel. <br /> <br />4. Each new lot must be landscaped in a manner similar to the concept plan <br />submitted in conjunction with the request for a variance. <br /> <br />5. The existing 36" oak tree shown on the survey must be preserved during <br />redevelopment of the site. <br /> <br />6. Utility easements five feet in width must be dedicated along the east and west <br />boundaries of each parcel in conjunction with the lot split. <br /> <br />7. A payment in lieu of parkland dedication in the amount of $500.00 for the second <br />parcel must be paid prior to a building permit being issued for either parcel. <br /> <br />8. A deferred storm sewer assessment (67-10) in the amount of$300.00 for the second <br />parcel must be paid prior to a building permit being issued for either parcel. <br /> <br />5.0 SUGGESTED PLANNING COMMISSION ACfION <br /> <br />5.1 By motion, recommend approval of Thomas Coil's request for a variance a variance from <br />Section 1004.02(D) of the City Code to reduce the width of two single family residential <br />lots from 85 feet to 64 feet for the purpose of splitting a 38,238 square foot parcel with <br />128.31 feet of frontage into two parcels at 1027 Shryer Avenue West and a variance to <br />reduce the side yard setbacks to five feet, based on the findings outline in Section 3.1 and <br />with the provisions outlined in Section 4.1. <br /> <br />5.2 The Planning Commission's recommendation will be forwarded to the City Council for <br />final action on November 23,1998. <br /> <br />Attachments: Property location map; notice of public hearing; proposed lot split; proposed site plan; proposed building <br />elevation; proposed building floor plan; photograph of property; photographs of neighborhood. <br />60-day Time Limit: Application accepted on October 12, 1998; Decision deadline is December 11, 1998. <br />Prepared by: Kim L.
