Paschke <br />City of RoseviUe <br />2660 Civic Center Drive <br />Roseville, MN 55113 <br /> <br />Dear Thomas: <br /> <br />I thank you for your letter of31 October regarding Compliance with conditions of approved Planned <br />Unit Development for our property at 1940-44 Lexington Avenue North. I would like to respond <br />to a few of the issues which were raised in your correspondence. <br /> <br />During our conversation of a few weeks ago, I asked that the Landscape Letter of Credit be returned <br />to us. Your response was that this would be done. I have not received this letter and your <br />Compliance letter indicated that you intended to retain this letter until a final landscape inspection <br />ensues next year: I believe that we have fulfilled our obligations regarding the landscaping and that <br />the letter of credit should be promptly returned to us. . To wait until the spring to determine whether <br />or not the trees survive is hot sufficient reason for the City of Roseville to retain this letter of credit. <br />Our banker, Jeffrey Neisen of North Star Bank, requires us to return this letter to him in order to <br />release funds to complete payment ofthe construction contracts. Please let me know when we might <br />expect the return of this letter. <br /> <br />Regarding an issue raised in your letter, the decorative street lights have always been on a timer and <br />are currently set to come on at 7 AM and go off at 10 PM. Of course, the timer is also controlled <br />by a photoelectric eye which will control the lights during the 7 AM -1 OPM period which may require <br />them to go off as the day brightens and go on as dusk approaches. As I expressed to you, I feel that <br />it is only right for us to receive the names of the citizens and Council Members who voiced their <br />concern regarding our lights. I would like to address these issues with them personally. The plural <br />nature of the those who expressed a concern is of interest to me. <br /> <br />Finally, it was called to my attention that the neighbors to the east, the Association, have asked <br />David Johnson of Suburban Hardware, to erect a continuation of the east side fence toward his <br />property and then back to his building in effect forming a right angle and blocking off the area <br />completely. David has refused to do s'o at his expense. I would prefer that the fence; not be <br />c,ontinued and would seek direction' from the City. regarding our rights.
