<br />3.0 STAFF COMMENT <br /> <br />3.1 In reviewing this request, staff made the following findings: <br /> <br />1. This drainage easement was included in the plat of CW Michael Third Addition <br />when it was platted in 1951. <br /> <br />2. Since storm sewer was installed in this area in 1966 and the culvert within the <br />easement was plugged, the drainage easement is no longer used or needed by the <br />City. <br /> <br />3. The proposed vacation of this drainage easement over Lot 5, Block 6, CW Michael <br />Third Addition, will not have an adverse impact on the general public health, safety <br />and welfare. <br /> <br />4.0 STAFF RECOMMENDATION <br /> <br />4.1 Based on the findings outlined in Section 3.1, staff recommends approval of the request <br />for vacation of the 16 foot drainage easement along the southwest side of the parcel at <br />2441 St. Albans Street North (Lot 5, Block 6, CW Michael Third Addition). <br /> <br />5.0 PLANNING COMMISSION ACTION <br /> <br />5.1 The Planning Commission held a public hearing on this request on Wednesday, November <br />18, 1998. Mr. VanBerkel was present to answer questions and provide additional <br />information. The Planning Commission recommended approval of the request for <br />vacation ofthe 16 foot drainage easement along the southwest side of the parcel at 2441 <br />St. Albans Street North (Lot 5, Block 6, CW Michael Third Addition), based on the findings <br />outlined in Section 3.1 (7-0).
