<br />REQUEST FOR CITY COUNCIL ACTION <br /> <br /> <br />DATE: 11/23/98 <br />ITEM NO: 1-1 <br /> <br />Man~ A1?proved: Agenda Section: <br />'-C:J-- +La' LAND USE <br /> <br />Thomas & Mary Sue VanBerkel request for vacation of a 16 foot wide <br />drainage easement along the southwest side of a parcel at 2441 St. Albans <br />Street North (PF3079). <br /> <br />1.0 REQUESTED ACTION <br /> <br />1.1 Thomas & Mary Sue VanBerkel are requesting the City of Roseville to vacate a 16 foot <br />drainage easement along the southwest side of their parcel at 2441 St. Albans Street North. <br />The vacation of this easement will provide the VanBerkels with additional area for the <br />construction of an attached garage on their property. <br /> <br />2.0 BACKGROUND <br /> <br />2.1 Thomas & Mary Sue VanBerkel own a parcel at 2441 St. Albans Street North. The property <br />is zoned R-1, Single Family Residential, and the Comprehensive Plan identifies the <br />property as Low Density Residential. All adjacent land uses are single family residential. <br /> <br />2.2 Mr. and Mrs. VanBerkel are proposing to construct a two-car attached garage and <br />screened porch on their property. Mr. VanBerkel was told that the side yard setback in <br />this area was five feet and he based his building plans on that information. When he <br />submitted an application for a building permit in late September, the presence of a 16 foot <br />utility easement along the southwest side of the parcel was identified. <br /> <br />2.3 The drainage easement on this parcel (Lot 5, Block 6, CW Michael Third Addition) was <br />included when the plat was approved iri 1951. A culvert placed within this easement <br />provided drainage from St. Albans Street to the northwest. Storm sewer was installed in <br />St. Albans Street in 1966 and the culvert within this easement was plugged. Although the <br />drainage easement is no longer needed, it has never been vacated. <br /> <br />2.4 The VanBerkel's have been issued a building permit for the footing/foundation portion <br />of their addition. This was done with the understanding that if the vacation was not <br />approved, the permit for a building in the easement area would not be issued. The <br />foundation of the garage would then be used as an open parking space, which is allowed <br />within the easement. <br /> <br />2.5 Section 1013.04 outlines the procedure for vacating streets, alleys, and easements. <br /> <br />PF3079 - RCA (11/23/98) - Page 10f2 <br />
