<br />2.4 Section 1016.13 of the City Code identifies Langton Lake as MnDNR ID# 204W and 49W, <br />with the classification of General Development. <br /> <br />Section 1015.03 outlines the procedure for amending the Chapter 10 (Zoning) ofthe City <br />Code, including text amendments. <br /> <br />3.0 Staff Comment <br /> <br />3.1 In reviewing this request, staff made the following findings: <br /> <br />1. Section 1016.13 identifies Langton Lake as a wetland through the use of MnDNR <br />identification number 204W and 49W. Changing the MnDNR identification <br />number to 49P will begin the process to change the designation of Langton Lake <br />from wetland to protected water. Upon approval of the amended shoreland <br />regulations by the MnDNR, the designation will be changed from wetland to <br />protected water. <br /> <br />2. The designation of Langton Lake as "protected water" versus "wetland" will allow <br />public access and improvement of the resource through human intervention. <br /> <br />3. The proposed amendment is in harmony with the general purpose and intent of the <br />City's Comprehensive Plan and Title 10 of the City Code (Zoning). The change in <br />designation also supports the goals of the Park and Recreation Plan for Langton <br />Lake. <br /> <br />4. The proposed amendment will not adversely affect the public health, safety, or <br />general welfare. <br /> <br />4.0 Staff Recommendation <br /> <br />4.1 Based on the findings outlined in Section 3.1, staff recommends that Section 1016.13 of <br />the City Code be amended to change the MnDNR identification number of Langton Lake <br />from 204W and 49W to 49P. <br /> <br />5.0 Planning Commission Action <br /> <br />5.1 The Planning Commission held a public hearing on this request on Wednesday, November <br />18, 1998. Pat Johnson, 2986 Mildred Drive, spoke in favor of the amendment and provided <br />an overview of the efforts to improve Langton Lake. The Planning Commission <br />recommended approval ofthe amendment to change the MnDNR identification number <br />of Langton Lake from 204W and 49W to 49P, based on the findings outlined in Section 3.1 <br />(7-0). <br /> <br />PF3081 - RCA (12/14/98) - Page 2 of 3 <br />
