2.4 Section 1016.13 of the City Code identifies Langton Lake as MnDNR ID# 204W and 49W, with the classification of General Development. Section 1015.03 outlines the procedure for amending the Chapter 10 (Zoning) ofthe City Code, including text amendments. 3.0 Staff Comment 3.1 In reviewing this request, staff made the following findings: 1. Section 1016.13 identifies Langton Lake as a wetland through the use of MnDNR identification number 204W and 49W. Changing the MnDNR identification number to 49P will begin the process to change the designation of Langton Lake from wetland to protected water. Upon approval of the amended shoreland regulations by the MnDNR, the designation will be changed from wetland to protected water. 2. The designation of Langton Lake as "protected water" versus "wetland" will allow public access and improvement of the resource through human intervention. 3. The proposed amendment is in harmony with the general purpose and intent of the City's Comprehensive Plan and Title 10 of the City Code (Zoning). The change in designation also supports the goals of the Park and Recreation Plan for Langton Lake. 4. The proposed amendment will not adversely affect the public health, safety, or general welfare. 4.0 Staff Recommendation 4.1 Based on the findings outlined in Section 3.1, staff recommends that Section 1016.13 of the City Code be amended to change the MnDNR identification number of Langton Lake from 204W and 49W to 49P. 5.0 Planning Commission Action 5.1 The Planning Commission held a public hearing on this request on Wednesday, November 18, 1998. Pat Johnson, 2986 Mildred Drive, spoke in favor of the amendment and provided an overview of the efforts to improve Langton Lake. The Planning Commission recommended approval ofthe amendment to change the MnDNR identification number of Langton Lake from 204W and 49W to 49P, based on the findings outlined in Section 3.1 (7-0).
