<br />District. Adjacent land uses include industrial to the east, low density to the north across <br />County Road C West, a combination of industrial and low density residential to the west, <br />and high density residential (Rosepointe) to the south. <br /> <br />2.2 Earlier this year, the applicant installed three above ground tanks on the property without <br />the proper permits. These tanks do not meet the size or separation requirements of the <br />Fire Code and have been ordered removed by the City's Fire Marshal. The deadline for <br />removing the tanks was October 12, 1998; however, a verbal extension was granted to <br />provide adequate time to process the applicant's request for above ground storage on this <br />site and the variance from the requirements of the Fire Code. <br /> <br />2.3 Above ground tanks must be set back a minimum of 50 feet from a property line and a <br />minim urn of 50 feet from any building on the property. If the amount of gasoline stored <br />above ground exceeds 500 gallons in one tank and/ or the amount of diesel stored above <br />ground exceeds 1,000 gallons in one tank, the dispensing unit(s) must be located a <br />minimum of 30 feet from the tanks. Based on the limited area on this site, the applicant <br />could not install the number and volume of tanks requested and meet the set back <br />requirements. For this reason, the applicant will need to request a variance from the Fire <br />Code. <br /> <br />2.4 Albrecht Companies has not yet submitted an application for plan review to the State Fire <br />Marshal and or a notification form to the Minnesota Pollution Control Agency. These <br />items will be submitted if the installation of the tanks are approved by the City Council. <br /> <br />2.5 Section 902.06A of the City Code, which regulates the storage of flammable liquids, states <br />that the storage of flammable liquids in outside aboveground tanks is prohibited in all <br />areas other than that area bounded by Cleveland Avenue, Highway 36, the northern City <br />limits, and the western City limits. <br /> <br />Section 902.06C of the City Code states, "notwithstanding the limits for aboveground <br />storage tanks established in subsections A and B above, such storage tanks in other non- <br />residentially zoned areas may be allowed by issuance of a permit approved by the City <br />Council. The permit is subject to review and recommendations of the Fire Marshal and <br />to conditions imposed by the City Council." This subsection also outlines the <br />requirements and standards for above ground storage tanks allowed under this provision. <br /> <br />3.0 STAFF RECOMMENDATION <br /> <br />3.1 Staff recommends approval of the installation of two 1,000 gallon above ground diesel tank <br />and one 500 gallon above ground gasoline tank, with the following conditions: <br /> <br />1. The proposed above ground storage tanks must be approved by the State Fire <br />Marshall. <br /> <br />2. The above ground tanks must be installed as shown on the approved site plan and <br />must be screened from eye level view from adjacent properties and public streets <br />by buildings, landscaping, or a screen wall.
